ROLL CALL Present: Mayor Goh, Councilmembers Arias (seated at 4:15 p.m.), Weir, Smith, Freeman (seated at 3:40 p.m.), Gray, and Kaur Absent: Vice Mayor Gonzales 2. PUBLIC STATEMENTS 2. a. Non -Agenda Item Public Statements 1. Michael Gridley spoke regarding issues with his neighbor. Mayor Goh requested staff reach out to Michael Gridley to discuss his Code Enforcement property violation case concerning the removal of a block wall. 2. Walter Keenan expressed his concerns regarding a short-term rental Airbnb in his neighborhood. 3. Antje Lauer spoke regarding item 7.e.8. on the 5:15 p.m. agenda; General Tree Services agreement and submitted written materials. 4. Eddy Laine and spoke regarding shade and tree removal. 5. Sharon Briel spoke regarding opposition to the General Tree Services agreement. 6. Paul Linfesty spoke regarding a sidewalk improvement program in his neighborhood that caused damage to a tree in front of his house. 7. Michael Turnipseed spoke regarding the Shot Spotter program and provided written material. Councilmember Freeman requested staff share the feedback received from several constituents regarding the ongoing maintenance of city trees with contractors. Councilmember Kaur requested staff review any case studies that exist where cities have been able to reduce the temperatures within their cities and explore the elements that may be incorporated locally. 2.b. Agenda Item Public Statements Michael Turnipseed spoke regarding UC Campus and provided written materials. 3. REPORTS 3. a. Workforce Development Initiative — Medical Education Assemblymember Dr. Jasmeet Bains will provide a brief report on a regional workforce development initiative. REPORTS continued item 3.a. continued City Manager Clegg made staff comments and Assemblymember Dr. Jasmeet Bains presented the report. Councilmember Weir requested staff present an update on the City's vision to include a local University California School of Medicine that aligns with Assemblymember's Dr. Jasmeet Bains workforce development initiative and present it to the City Council in the next 30-60 days. Motion by Councilmember Weir to receive and file the report. Motion was approved with Vice Mayor Gonzales absent. 3.b. Public Safety Update and presentation will be provided by Bakersfield Police Department Chief Greg Terry. (Staff recommends the Council receive and file the report.) Police Chief Terry made staff comments and provided a PowerPoint presentation. Councilmember Arias requested staff analyze the safety data to understand the increases in occurrences of domestic violence, what resources are available in the community, and how the city may support those resources. Motion by Councilmember Weir to receive and file the report. Motion was approved with Vice Mayor Gonzales absent. 4. CLOSED SESSION 4.a. Conference with Legal Counsel — Initiation of Litigation; Closed Session pursuant to Government Code Section 54956.9(d)(4) (2 matters) Motion by Councilmember Weir to adjourn to Closed Session at 5:19 p.m. Motion approved with Vice Mayor Gonzales absent. The Closed Session meeting was adjourned at 5:54 p.m. Meeting reconvened at 5:54 p.m. 5. CLOSED SESSION ACTION 4.a. Conference with Legal Counsel — Initiation of Litigation; Closed Session pursuant to Government Code Section 54956.9(d)(4) (2 matters) By unanimous direction 6-0, with Vice Mayor Gonzales absent, the City Council authorized the City Attorney to initiate litigation in both matters. 6. Johnny Olaguez spoke regarding inability to meet with city staff and requested an email indicating he is no longer permitted onto city property due to pending litigation. 2. Cecilia, Valeria, and Carmen spoke in opposition to the conflict in Gaza. 3. Kev spoke regarding the removal of trees downtown and in opposition to the conflict in Gaza. 4. Brian made comments about the Council meeting procedure and in opposition to the conflict in Gaza. 5.b. Agenda Item Public Statements None. 6. APPOINTMENTS None. 7. CONSENT CALENDAR 7.a Minutes: 7.a.1. Approval of minutes of the June 26, 2024, Regular City Council Meetings. (Staff recommends approval of the minutes.) Agreement with Mercy House Living Centers ($63,154.79) for one-time Capital Purchasing Costs related to the 50-bed Brundage Lane Navigation Center Emergency Shelter Expansion. (Staff recommends approval of the agreement.) AGR 2024-196 7.e.2. License Agreement with the County of Kern for Shared Use of City of Bakersfield and County of Kern Parking Facilities Shared Use of the Kern County Parking Structure, Civic Center Justice Building Parking Lot, Juror Parking Lot, and Mechanics Bank Arena, Theater and Convention Center Parking Lot. (Ward 2) (Staff recommends approval of the agreement.) AGR 2024-197 7.e.3. Agreement with Railworks Track Services, Inc., (not to exceed $400,000 for a four- year term expiring June 30, 2028) for scheduled and on -call maintenance and repair services for the Bakersfield Amtrak Railroad track from H Street to Union Avenue. (Ward 2) (Staff recommends approval of the agreement.) AGR 2024-198 7.e.4. Cooperative agreement with County of Kern and the City of Shafter ($1,500,000) for improvements to Seventh Standard Road and State Route 43 including design, utility relocation and right-of-way acquisition. Amendment No. 7 to Agreement No. 2021-009 with The Open Door Network ($64,480; not to exceed $4,124,020.16 and extend working hours) to cover nights and weekends and hire an additional supervisor. (Staff recommends approval of the amendment.) AGR 2021-009 (7) 7.e.6. Amendment No. 1 to Agreement No. 2023-011 with WGJ Enterprises Inc., dba PCI (increase compensation by $500,000 and extend term to July 31, 2025) to provide on -call pavement striping and marking services for Public Works Street Maintenance Division. (Staff recommends approval of the amendment.) AGR 2023-011 (1) 7.e.7. Amendment No. 5 to Agreement No. 2020-130 with Granite Construction (increase compensation by $9,500,000; revised not to exceed $44,500,000 and extend term by one year) to continue the supply of street materials. (Staff recommends approval of the amendment.) AGR 2020-130 (5) 7.e.8. Amendment No. 3 to Agreement No. 2021-180 with General Tree Service, Inc. (increase compensation by $1,000,000; revised not to exceed $3,720,000 and extend the term by one year) to continue the supply of tree trimming services. (Staff recommends approval of the amendment.) AGR 2021-180 (3) 7.f Bids: 7.f.1. Pavement Rehabilitation 23-24 RSTP - Panama Lane from Gosford Road to Stine Road: (Staff recommends acceptance of low bid, approval of contract, and approval of City -controlled contingency.) Accept bid and approve contract with Granite Construction Co. ($6,577,779) for the project. AGR 2024-200 2. Authorize staff to approve, as necessary, up to $300,000 in City -controlled contingency for unforeseen conditions encountered during construction of project. (Wards 6 & 7) 7.f.2. Median Improvements at Various Locations — Jewetta Avenue, Camino Media, Hosking Avenue, and Panama Lane. (Staff recommends acceptance of low bid, approval of contract, appropriation of funds, and approval of City- controlled contingency.) Motion was approved with Vice Mayor Gonzales absent. 8. CONSENT CALENDAR PUBLIC HEARINGS 8.a. Public hearing to consider a resolution adopting sewer connection fees for fiscal year 2024-25. City Clerk Drimakis announced a staff memorandum was received requesting item 8.a. be removed from the agenda and be presented at the August 28, 2024, Council Meeting. 8.b. Public Hearing to consider first reading of an ordinance for Zone Change 24-0339 Housing Element Rezones changing zone classifications from A (Agriculture) Zone, E (Estate) Zone, R-1 (Single -Unit Dwelling) Zone, R-1-HD (Single -Unit Dwelling - Hillside Development) Combining Zone, R-2 (Small Lot Single -Unit Dwelling) Zone, R-3 (Medium Density Multi -Unit Dwelling) Zone. Public Hearing to consider a resolution for Vesting Tentative Tract Map 7356 (Phased) McIntosh & Associates representing Castle & Cooke California, Inc. is proposing to subdivide approximately 63.5 acres into single-family residential lots and various private and public lots for streets, landscaping, and other ancillary uses in the WM-R1 (West Ming -One Family Dwelling) zone generally located at the southwest corner of Ming Avenue and Highgate Park Boulevard. Soluri Meserve, a Law Corporation representing Friends of the Bakersfield Kit Fox and Environment, submitted an appeal to the Planning Commission's approval of the request. (Ward 5) RES 102-2024 City Clerk Drimakis announced a staff memorandum was received transmitting additional correspondence in opposition. Planning Development Director Johnson made staff comments provided PowerPoint Presentation. Councilmember Freeman abstained from the item due to personal financial effect and the appearance of a conflict of interest. Hearing item 9.a. opened at 6A0 p.m. Dante Almaguer spoke in opposition. Scott Thayer, McIntosh & Associates, spoke in support and provided written materials. Hearing item 9.a closed at 6A4 p.m. Motion by Councilmember Smith denying the appeal and upholding the Planning Commission's decision to approve Vesting Tentative Tract Map No. 7356. Motion was approved with Vice Mayor Gonzales absent and Councilmember Freeman abstaining due to personal financial effect and the appearance of a conflict of interest. 8.b.
