RAILWAY IN ~ CITY OF BAKERSFIELD. WlCIEREAS, on WEDNESDAY, JANUARY 22, 1997, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1156 declaring its intention to order the vacation of"M" Street between 102.7 feet north of 14th Street and the A. T. & S. F. Railway in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is categorically exempt from CEQA according to Section 15305 (Class 5) of CEQA guidelines in that the street vacation is a minor disposition of existing public right of way and is therefore exempt from CEQA as a minor alteration in !and use limitation; and WHEREAS, at its meeting on December 19, 1996, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan. WI~REAS, said Council did fix a time and place for heating all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, February 19, 1997, after notices were duly published and posted as required by law. NOW, Tm~REFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. "M" Street between 102.7 feet north of 14th Street and the A. T. & S. F. Railway, City of Bakersfield, County of Kern, State of California, more particularly described as that portion of the 82.5 foot wide public street fight of way for "M" Street bounded northerly by a prolongation of north line of Block 350 and bounded southerly by a prolongation of the north line of the south 102.7 feet of Block 350 as streets and blocks are shown on "Map of the City of Bakersfield" filed for record November 25, 1898 in the Office of the Kern County Recorder, is unnecessary for present or prospective use for public road purposes and is hereby vacated, subject to the conditions enumerated herein. A non-exclusive easement shall be reserved for public utilities purposes in under, over and upon the entire above described street right of way area. Full access for utilities shall be maintained to the greatest extent possible. Pacific Bell Company shall be allowed to view and comment on parking lot plans prior to construction. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. ...... 000 ......
