SUBJECT: NEPOTISM RULING — KELSEY BRACKETT
CANDIDATE FOR ASSISTANT CODE ENFORCEMENT OFFICER (0) #02176
Kelsey Brackett has successfully competed in the examination process for the position of Assistant Code Enforcement
Officer and has been placed on the eligible list for same. Her spouse, Nicholas Brackett, is currently employed as a
Senior Police Officer in the Bakersfield Police Department. Due to the possibility of Kelsey being considered for the
Assistant Code Enforcement Officer position, the issue of nepotism must be addressed.
The following information has been compiled for your review and determination of whether nepotism creates an
adverse impact on supervision, safety, security or morale.
UMMARY OF DUTIES
A summary of the duties and responsibilities for the position Assistant Code Enforcement Officer is as follows: Under
close supervision, performs entry-level work to support Code Enforcement Officer 1/11's to secure compliance with
property regulations, zoning regulations, and the Municipal Building Codes. Work involves assisting with the resolution
of routine conservation issues within established policy. Employees will be required to wear a badge and operate City
vehicles in performing their job duties. Incumbents are closely supervised on a daily basis by the Code Enforcement
Officer III and receive daily field direction from Code Enforcement Officer 1/11's. Employees in this class do not have
citation authority. Performs other work as required.
A summary of the duties and responsibilities for the position of Senior Police Officer is as follows:
Under general supervision, performs routine to complex tasks and duties performed by the Police Officer class of a
more technical nature. A primary responsibility of this position is to serve in a lead capacity which would include tasks
to organize, facilitate, and guide work assignments at the direction of the supervising Sergeant. Performs other work as
required.
EMPLOYMENT OVERLAP
According to the Development Services Director, Phil Burns, if Kelsey Brackett is appointed to a Assistant Code
Enforcement Officer position in the Building Division of the Development Services Department, performance appraisals
would not be reviewed or conducted by either employee for the other; neither employee would be directly supervised
by the other; and they would not report to each other within the chain of command as they would be assigned to
different departments.
RECOMMENDATION
The Development Services Director, Phil Burns, and the Human Resources Department recommend approval of the
nepotism. If this request is approved, however, nepotism considerations may adversely affect future appointments,
transfers or promotional opportunities.

Sheldon Croney is competing in the examination process for the position of Assistant Code Enforcement Officer. His son, Quentin
Croney, is currently employed as a Police Officer in the Police Department. Due to the possibility of Sheldon being considered for
appointment to an Assistant Code Enforcement Officer, the issue of nepotism must be addressed. Sheldon is currently employed as a
Service Maintenance Worker in the Development Services Department.
The following information has been compiled for your review and determination of whether nepotism creates an adverse impact on

EMPLOYMENT OVERLAP
According to the Development Services Director, Phil Burns, if Sheldon is appointed to an Assistant Code Enforcement Officer in the
Development Services Department, performance appraisals would not be reviewed or conducted by either employee for the other,

The Municipal Code provides that if the duties and responsibilities of an employee
within a class are sufficiently like the duties and responsibilities of a position of another
class, the position may be reclassified to an appropriate position (Section 2.72.070 -
Reclassification). Such actions are subject to certification of the appropriate civil
service board.
With the adoption of the FY 2024-2025 annual, the Water Resources Department has
merged with the Wastewater Division, to establish the newly named Water
Department. The Wastewater Division was formerly within the Public Works
Department. This merger is inclusive of the fifty-one staff who support the wastewater
operations. The re -organization expands personnel programs and general
administrative functions necessitating review of the organizational chart to align
functions for maximum efficiencies and oversight.
The Hydrographic Supervisor position is responsible for record -keeping functions of the
Hydrographic Division on behalf of the Water Department and Central Records for the
Kern River. This position is responsible for the City's forecasting and planning of its Kern
River water supplies.
Through the process of reviewing the organizational structure with the merging of
Wastewater, the Department has identified the need to reclassify this position to
Hydrographic Manager. With the reorganized structure, the Hydrographic Managerwill
have the Water Resources Planner position as a direct report, who previously reported
to the director. This increases the scope of work within the Hydrographic Division and
provides managerial oversight to planning efforts, records and general oversight of the
Kern River Operations. Specifically, the Hydrographic Manager will oversee planning
efforts for the City's water supplies, implementation of the Groundwater Sustainability
Plan and Kern River operations.
The incumbent, Miguel Chavez, is employed with the Water Department, since 2013,
holding a variety of positions within the department and increasing knowledge and
skills in water operations. Upon review of the employee's job duties, and goal to

appropriate fit for the Water Department.
Therefore, based on the above and as approved by the Water Director, Kristina

reclassification.
Changes to the structure are included in the FY 2024-25 Water Department budget

Department Head in that the latter has full management and administrative
