A RESOLUTION DISPENSING WITH BIDDING PROCEDURES
DUE TO NEED FOR EMERGENCY WATER SUPPLY LINE FOR
THE FIRE SUPPRESSION SYSTEM AND AUTHORIZING HPS
MECHANICAL TO PROVIDE SERVICES AND MATERIALS
NECESSARY TO INSTALL THE WATER SUPPLY LINE FOR THE
FIRE SUPPRESSION SYSTEM, NOT TO EXCEED THREE
HUNDRED SEVENTY-NINE THOUSAND NINE HUNDRED
NINETY-FIVE DOLLARS ($379,995.00).
WHEREAS, the Materials Recovery Facility (MRF) located at 2260 South Union
Avenue has endured several minor and major fires due to hazardous materials
(such as lithium -ion batteries) in the waste stream that have caused fire damage
to the building and equipment; and
WHEREAS, on May 11, 2023, the MRF experienced a major fire when a pile
of recyclable materials caught fire in the early morning hours, ultimately resulting
in more than $90,000 in fire damage to the building and existing equipment,
almost $50,000 in lost revenue of recyclable commodities, and more than
$450,000 to pay an outside facility to process the rerouted materials; and
WHEREAS, on May 3, 2024, the MRF experienced another major fire when
large piles of cardboard caught fire in the afternoon, causing thousands of dollars
in lost revenue; and
WHEREAS, during 2024, additional minor fires occurred at the MRF, which
were extinguished by staff or the fire department, and resulted in no material loss
on January 29, May 22, July 10, and recently on August 5; and
WHEREAS, a staff assessment of the facility concluded that the current fire
suppression system for the inbound material tipping pads was not adequate for
fire mitigation and an emergency water supply line for the fire suppression system
is needed, and
WHEREAS, after assessing the fire mitigation needs, the Public Works Director
declared this installation to be an emergency requiring work, supplies, equipment,
and materials urgently necessary for the preservation of life, health, and property;
and
WHEREAS, the Public Works Director determined that the installation cannot
be made by City staff; and
WHEREAS, staff conducted research and reached out to eight companies

for quotes to assess and perform the fire suppression work at the facility in which
only one firm responded; and
WHEREAS, the Public Works Director recommends the Council authorize the
proposed repairs and dispense with bidding requirements, in accordance with
subsection DA of Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
The foregoing findings and recitals are true and correct, and
incorporated by reference herein.
2. Based upon the facts included in the above recitals, the work is
hereby deemed to be of urgent necessity for the preservation of life,
health or property.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds to the HPS MECHANICAL for the services
and materials shall not exceed $379,995.00.
