A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING THE APPLICATION AND
ACCEPTANCE OF PARKS CALIFORNIA GRANT IN THE
AMOUNT OF $250,000 TO THE CITY OF BAKERSFIELD, FOR
SAUNDERS PARK ACTIVATION THROUGH ART AND NATURE.
WHEREAS, Parks California is the official California nonprofit public benefit
corporation, in support of the California State Department of Parks and
Recreation (Department); and
WHEREAS, Parks California sets up the necessary procedures governing
applications and awards for The Arts in California Parks Local Parks Grant
Program; and
WHEREAS, on April 29, 2024, City submitted a proposal to Parks California for
Saunders Park for a more welcoming park experience for the surrounding
community through art including a community vetted mural, ADA compliant
walkway, walkway lighting, and benches; and
WHEREAS, on October 4, 2024, Parks California awarded the grant to the
City in the amount of $250,000.00 in order to support the Saunders Park Activation
Through Art and Nature; and
WHEREAS, said. procedures established by Parks California require the
grantee's Governing Body or its designee enter into a Grant Agreement
(Agreement) for the intended use of grant funds; and
WHEREAS, among other things, the Agreement requires the indemnification
of Parks California and the Department, their officers, agents, and employees;
and
WHEREAS, City will enter into an Agreement with Parks California to
complete the project; and
NOW THEREFORE, be it resolved by the City Council of the City of Bakersfield
as follows:
Approves the submittal of the project application, as well as the
acceptance of the Agreement between the City and The Arts in California
Parks Local Parks Grant Program administered by Parks California for
Saunders Park Activation Through Art and Nature; and

2. Approves City staff entering into said Agreement and adhering to the terms
and conditions of the grant and proposal; and
3. The above recitals are true and correct and are incorporated herein by
reference; and
4. Certifies that all projects proposed will be consistent with the park and
recreation element of the City of Bakersfield general or recreation plan
(PRC §80063(a)), and
5. Certifies that it will comply with the provisions of § 1771.5 of the State Labor
Code; and
6. Delegates the authority to the Recreation and Parks Director, or designee
to conduct all negotiations, sign and submit all documents, including, but
not limited to applications, agreements, amendments, and payment
requests, which may be necessary for the completion of the grant scope(s);
and
7. Agrees to comply with all applicable federal, state and local laws,
ordinances, rules, regulations and guidelines.

HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
