RESOLUTION NO.
A RESOLUTION DETERMINING THAT THE
HEXAGON EAM SOFTWARE CANNOT BE
REASONABLY OBTAINED THROUGH USUAL
BIDDING PROCEDURES AND AUTHORIZING
THE FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFORE, NOT TO EXCEED
$ 180,638.
WHEREAS, the City may dispense with bidding and enter into a resolution
for work, supplies, equipment or materials because of the necessity to successfully
integrate such work, supplies, equipment or materials into an exisfing city project
or system pursuant to Bakersfield Municipal Code Section 3. 20.060(D) (2); and
WHEREAS, on June 28, 2019, the City entered into Agreement 2019-109 for
the purchase of Infor EAM Software for use with the City's Wastewater Division and
WaterResources Department, which was amended several times thereafter; and
WHEREAS, the City needs to renew the annual software subscription of the
newest version of Infor EAM software, now referred to, as Hexagon EAM Software,
for continued use by the City's Wastewater Division and Water Resources
Department; and
- WHEREAS, Bakersfield Municipal Code Section 3.20.060(D) (2) allows the City
to dispense with bidding procedures when it is determined that work, supplies,
equipment or materials are available from one vendor for the successfully
integration of such work, supplies, equipment or materials into an existing city
system, and therefore dispensing with bidding in this instance is necessary to
continue integrated use of the EAM software in this City's existing systems.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are' ncorporated herein
by reference.
2. The Council finds that work, supplies, equipment, or materials are
available from one vendor that has successfully installed equipment or materials
into an existing city system, and that it is in the best interests of the city, and to the
city's' economic advantage to purchase such work, supplies, equipment, or
materials from that vendor at the lowest possible cost for the quality needed.

3. The Finance Director or his designee is authorized to dispense with
bidding in accordance with section 3.20.060(D) (2) of, the Bakersfield Municipal
Code.
- 4. The Finance Director or his designee is authorized to purchase
Hexagon EAM Software Annual Software Subscription through one vendor, EAM
Solutions and to negotiate the purchase of same, not to exceed $180,638.
5. That the Finance Director or designee is authorized to negotiate and
execute any documents that may be necessary to register with, and purchase
work, supplies,, equipment, or materials from, the vendors herein.
