A RESOLUTION DETERMINING THAT THE TASER
10 CONDUCTED ENERGY WEAPON SYSTEM
(CEW) CANNOT BE REASONABLY OBTAINED
THROUGH THE USUAL BIDDING PROCEDURES
AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFORE AND
PURCHASE DIRECLTY FROM THE
MANUFACTURER, AXON ENTERPRISE, INC.
NOT TO EXCEED $2,506,394.05
WHEREAS, the Bakersfield Police Department (BPD) has utilized CEW systems
manufactured and supplied by Axon Enterprise, Inc. since 1998.-Axon Enterprise,
Inc. is the only manufacturer that provides a product of this type which has been
studied and litigated; and
WHEREAS, CEW Systems have proven to be a valuable asset for the BPD
personnel during encounters with violent, resistant and combative individuals.
These devices provide BPD personnel with a means to safely incapacitate such
individuals while minimizing risk of injury to officers, suspects, and uninvolved
parties, and reduce the need for other levels of injury or deadly force; and
WHEREAS, Axon Enterprise, Inc. has released the Taser 10 model of its CEW
system which provides significant enhancements over the currently used Taser 7
model; and
WHEREAS, Axon Enterprise, Inc. is the sole source provider for the Taser 10
Certification Plan package which include all hardware, software, licensing,
warranties and accessories, as well as advanced virtual reality training aimed to
improve de-escalation techniques; and
WHEREAS, the Finance Director has determined and has recommended
City Council find, Taser 10 model can only be reasonably obtained from one
vendor, Axon Enterprise, Inc. because of the manufacturer's designation and has
recommended that Council authorize the Finance Director to dispense with
bidding requirements in accordance with subsection D.2 of Section 3.20.060 of
the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein
by reference. OAKF-

2. The Council hereby finds that the purchase of Taser 10 model, to be
used exclusively by the Bakersfield Police Department, can only be reasonably
obtained from one vendor, Axon Enterprise, Inc. for the reasons set forth above.
3. The Finance Director is authorized to dispense with bidding therefore
in accordance with Section 3.20.060 of the Bakersfield Municipal Code and to
negotiate the purchase of same as needed, for a total not to exceed amount of
$2,506,394.05.
HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on
