I humbly request a waiver of two Captain promotion eligibility requirements. Namely, the following
criteria:
1. Two (2) years as a Police Lieutenant with the Bakersfield Police Department
2. Possession of a POST Management Certificate
Beginning on October 11, 2021, and through July 30th, 2023, to meet the operational needs of the
Bakersfield Police Department, I was assigned as an acting Lieutenant in the Administration
Division as a Sergeant. The assignment required me to fulfill the roles and responsibilities of a
Police Lieutenant. It included premium pay above my regular wages to match the assignment and
duties of a Lieutenant. On July 31st, 2023, 1 was permanently assigned as a lieutenant in the same
role.
In total, I have been recognized as and held the role and responsibilities of a Bakersfield Police
Lieutenant for three (3) years and seven (7) months, well over the requirement for the position of
Police Captain.
Additionally, technically, California POST does not recognize the role of `acting' Lieutenant. Only
the time accrued since July 31, 2023, is considered time in a management role to satisfy the two-
year time -in -grade requirement to obtain that certification. However, I completed the required
training for the POST Management certification in March 2024 and will receive the final
certification in July 2025.
Based on my body of work, cumulative time spent fulfilling the role of Lieutenant at the
Department's request, and meeting all other requirements for the position of Captain and the
POST Management Certificate, I believe a waiver of these requirements is warranted. Further, I
am aware of the precedent of waivers granted by the Civil Service Commission for the same
circumstances on several occasions. I request that the precedent be considered as well. I have
included documentation indicating my appointment to acting Lieutenant in 2021 through 2023 as
described above and completion of the requisite training required for Management Certification.

Subject: Waiver Request — Police Captain Promotional Process
The City of Bakersfield Human Resources Department recently posted the Job Bulletin for the
position of Police Captain. The filing deadline for the position is January 71h, 2025, with a tentative
examination to occur the week of January 271, 2025.
The position of Police Captain requires, among other things, possession of a Management
Certificate from the California Commission on Peace Officer Standards and Training, (or P.O.S.T.
Commission.) The requirements for the certification include completion of a P.O'.S.T. certified
Management Course and two years of permanent management level experience, at the rank of or
equivalent to Lieutenant. The P.O.S.T. Commission does not consider time in "acting or
"temporary" capacities when accounting for the two-year requirement.
Having served as an acting Lieutenant for approximately two months, I was promoted to
probationary Police Lieutenant on January 30th, 2023, and will meet the two-year P.O.S.T.
requirement on January 301h, 2025. This is the same week as the tentative promotional
examination process, but roughly three weeks after the filing deadline. I have submitted a request
for the certificate to the P.O.S.T. commission and is anticipated that I will have obtained my
Management Certificate before the Eligibility List is certified by the Civil Service Commission.
I am respectfully requesting a waiver in accordance with Civil Service Rule 5.04: Persons who do
not meet the minimum qualifications for promotional examinations may submit an application to
participate in the examination process and request a waiver to such minimum qualifications prior
to the testing procedure. The waiver request must be written and delivered to the secretary of the
Civil Service Commission at least five working days prior to the next scheduled Civil Service
Meeting and prior to the start of the testing process. The person requesting the minimum
qualifications waiver should be present at the Civil Service meeting for a hearing on such
waiver. The decision of the Civil Service Board on waiver requests is final.
Aside from the two-year requirement, I have met all other minimum qualifications for the position
