BACKGROUND AND TIMELINE:
• March 22, 2006 - City Council approved Zone Change No. 05-0725, which pre-zoned the property from
A (Agriculture) to R-1 (One Family Dwelling) bringing consistency with the General Plan designation.
A Mitigated Negative Declaration was also adopted (Ordinance No. 4336)
• January 18, 2007 - The project site was annexed into the City as part of a larger area (Annexation No.
495; Reina No. 6).
• January 3, 2008 - The Planning Commission approved Vesting Tentative Tract Map (VTTM) No. 7039
consisting of 119 single-family residential lots on 40.05 acres. At that time, the Planning Commission
determined the use of a previously adopted mitigated negative declaration for Zone Change No. 05-
0725 was appropriate for this project (Ord. No. 4336).
• April 16, 2014 - City Council approved General Plan Amendment No. 13-0388 (Resolution No. 60-14),
which amended the Metropolitan Bakersfield General Plan Circulation Map and Western Rosedale
Specific Plan Trails Map to reflect the collector agreement approved by the County Board of
Supervisors in 2006 (Resolution 2006-498).
• February 7, 2019 - The Planning Commission approved the first of two, 3-year extension of time in
accordance with the Subdivision Map Act and the Bakersfield Municipal Code. The extension
approved an expiration date of January 2, 2022 (Resolution No. 18-19).
• January 20, 2022 - The Planning Commission approved the second of two, 3-year extension of time in
accordance with the Subdivision Map Act and the Bakersfield Municipal Code. The extension
approved an expiration date of January 2, 2025 (Resolution No. 01-22).
• October 24, 2024 - The applicant submitted a completed application requesting an extension of time
for VTTM 7039 pursuant to Government Code Section 66452.26 (AB 2973) (further detail provided
below under “Analysis”).
PROJECT ANALYSIS:
The proposed vesting tentative tract subdivision consists of 119 lots on 40.05 acres for purposes of single-
unit dwelling residential development. The residential lots range in size from 7,000 square feet to 15,000
square feet, and the typical lot size is approximately 70 feet wide by 100 feet deep (7,000 square feet).
The net density is 5.63 units per acre which is consistent with the Low Medium Density (“LMR”)
designation of the project site of between 4 and 10 dwelling units per net acre.
Extension of Time. The applicant is requesting a two-year extension to allow additional time to obtain
approval for the improvement plans and to record the final maps. Pursuant to Government Code Section
(GC) 66452.26 (AB 2973, effective January 1, 2019), single-family or multi-family residential maps
approved between January 1, 2006, and July 11, 2013, which had their expiration date extended under
Government Code Section 66452.25, are eligible to apply for this extension.
Government Code Section 66452.26 (effective January 1, 2019) approved a 24-month extension of time
for approved tentative and vesting tentative tract and parcel maps meeting certain requirements,
including but not limited to the tentative map a) was approved between January 1, 2002 and July 11,

2013; b) located in a county where certain indicators such as substandard annual income, higher
unemployment rates, or higher poverty rate show the county economically disadvantaged. Kern County
meets some of those economic markers.
To date, the final map for the first phase of VTTM 7039 has gone through three plan checks, and the
improvement plans have undergone several reviews. However, none of the improvement plans have
received approval yet, which is necessary before bonds can be issued. VTTM 7039 is tentatively scheduled
to be recorded on December 24, 2024. However, this deadline may not be met if the improvement plans
are not approved before the November 18, 2024, deadline. Granting this extension will provide the
developer with the additional time needed to record the final maps for each phase of development. The
applicant submitted a written request for the extension before the expiration date of January 2, 2025.
Circulation. Access to this subdivision would be from Renfro Road (arterial) on the subdivision’s east
boundary and from future Rosedale Ranch Parkway (collector) which bisects the subdivision and is a
requirement to improve Rosedale Ranch Parkway within the boundaries of VTTM 7039
Compliance with Standards. The proposed project, subject to the original conditions of approval,
complies with the ordinances and policies of the City of Bakersfield.
ENVIRONMENTAL REVIEW AND DETERMINATION:
The extension of time request is not subject to the provisions of the California Environmental Quality Act
(“CEQA”) in accordance with Section 15061(b)(3) because the project [extension of time] will not result in
either a direct or a reasonably foreseeable indirect physical change in the environment.
PUBLIC NOTIFICATION:
Public notice for the proposed project and environmental determination was advertised in The Bakersfield
Californian and posted on the bulletin board in the City of Bakersfield Development Services Building,
1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were
notified by United States Postal Service mail regarding this public hearing in accordance with city
ordinance and state law.
Comments Received. As of this writing, no written public comments have been received.
CONCLUSIONS:
Recommendation. The applicant provided the application for the Extension of Time in a timely manner
and the request adheres to the extensions permitted by Bakersfield Municipal Code 16.16.080. The
requested two-year extension will allow the developer additional time to record final map. VTTM 7039
has met the criteria provided in GC Section 66452.25 and 66452.26 to request the two-year extension.
Based on information in the record, staff recommends your Commission adopt Resolution and suggested
findings APPROVING the extension of time for Vesting Tentative Tract Map 7039 to expire on January 2,
2027, with no changes to previously approved conditions of approval.

DRAFT RESOLUTION OF THE BAKERSFIELD PLANNING COMMISSION TO APPROVE AN EXTENSION OF TIME FOR VESTING TENTATIVE TRACT MAP 7039 (PHASED) LOCATED AT THE NORTHWEST CORNER OF REINA ROAD AND RENFRO ROAD.
WHEREAS, McIntosh and Associates, representing DR Horton, filed an application with
the City of Bakersfield Planning Department requesting an extension of time for Vesting Tentative
Tract Map 7039 (the “Project”) located in the City of Bakersfield as shown on attached (Exhibit
“A”); and
WHEREAS, the application was submitted on October 24, 2024, which is prior to the
expiration date of Vesting Tentative Map 7039, and in accordance with the provisions of Section
16.16.080 of the Bakersfield Municipal Code; and
WHEREAS, in accordance with Government Code Section 66452.26, the Applicant is
requesting a 24 month extension of time for the tentative map; and
WHEREAS, Government Code Section 66452.26 requires that the tentative maps for
single-family and multifamily housing meet criteria related to previously approved extensions
of time and county-wide economic indicators; and
WHEREAS, the original application of the tentative map was deemed complete on November 16, 2007, conditionally approved by the Planning Commission on January 3, 2008;
and WHEREAS, a Negative Declaration was prepared and approved by the City Council on
March 22, 2006, in conjunction with Zone Change No. 05-0725 and in accordance with CEQA; and WHEREAS, there have been no substantial changes to the Project or circumstances under which it will be undertaken; and
WHEREAS, no new environmental impacts have been identified; and
WHEREAS, the Project is exempt from the requirements of the California Environmental
Quality Act (CEQA), pursuant State CEQA Guidelines Section15061(b)(3), Common Sense
Exemption; and
WHEREAS, the Secretary of the Planning Commission set, Thursday, January 16, 2025, at
5:30 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for a public hearing before the Planning Commission to consider the
application, and notice of the public hearing was given in the manner provided in Title Sixteen
of the Bakersfield Municipal Code; and
WHEREAS, the facts presented in the staff report, environmental review evidence
received both in writing, and the verbal testimony at the above referenced public hearing
support the following findings:

1. All required public notices have been given. Hearing notices regarding the Project
were mailed to property owners within 300 feet of the Project area and published in the Bakersfield Californian, a local newspaper of general circulation, 10 days prior to
the hearing.
2. The provisions of the CEQA have been followed.
3. Pursuant to State CEQA Guidelines Section 15061 (b) (3), the activity (extension of
time) is not considered a project for purposes of CEQA. CEQA does not apply if the
activity [extension of time] will not result in either a direct or a reasonably foreseeable
indirect physical change in the environment.
4. This request for an extension of time is pursuant to Bakersfield Municipal Code Section
16.16.080 and Subdivision Map Act Section 66452.26.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Bakersfield
as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The project is exempt from CEQA, pursuant to CEQA Guidelines Section15061(b)(3),
Common Sense Exemption.
3. Vesting Tentative Tract Map 7039 meets the criteria as described in Government
Section 66452.26 that allows a 24-month extension of time.
4. The expiration date of Vesting Tentative Tract Map 7039 is hereby extended until January 2, 2027.
