The Fire Department Civil Service Regular Meeting commenced on Monday, July 8, 2024, at
3:00 p.m. at Fire Station # 1.

3. Approval of the Minutes of the Regular Meeting of April 8, 2024, of the Bakersfield Fire
Department Civil Service Board.
Upon a motion by Commissioner George, seconded by Commissioner Burton, to approve
the Minutes of the Regular Meeting of April 8, 2024, of the Fire Department Civil Service
Board. APPROVED, ALL AYES.
4. New Business
A. REQUEST TO OPEN EXAM -FIRE CAPTAIN (PROMOTIONAL) #02165
After discussion, a motion was made by Commissioner George, seconded by
Commissioner Burton to approve staff recommendation, and approve the
Request to open Exam -Fire Captain (Promotional) #02165 recruitment.
APPROVED, ALL. AYES
5. Commissioner Statements
Commissioners thanked Human Resources and the Bakersfield Fire Department for their
recruiting efforts, additionally Chief Frando was asked number of fires from the July 4
celebration which 58 was the reply.
6. Adjournment
There being no further business to come before the Board, Chair Thomas Edmonds
adjourned the meeting at 3:06 p.m.

SUBJECT: NEPOTISM RULING -MARK RODRIGUEZ
CANDIDATE FOR HAZARDOUS MATERIALS SPECIALIST #02213
Mark Rodriguez has been placed on the Eligible List for the position of.Hazardous Materials Specialist.
His uncle, Joshua Rudnick is currently employed as a Deputy City Attorney II in the City Attorney's Office.
Therefore, the issue of, nepotism most be addressed and reviewed prior to appointment. Mark is
currently employed as a Fire Prevention Environmental Officer I in, the Bakersfield Fire -Department.
The following information has been compiled for your review and determination as to whether
nepotism creates an adverse impact on supervision, safety, security or morale, or involves a significant
potential for conflicts of interest, as determined by the Fire Civil Service Board.
SUMMARY, -OF DUTIES
A summary of the duties and responsibilities for the position of Hazardous Materials Specialist is as
follows:, Under general supervision, performsjourney level responsible technical level duties in enforcing
compliance with codes, laws, ordinances and regulations relating to fire_prevention, hazardous
materials, hazardous waste and above/underground storage tanks; resolves a wide range of difficult
and complex environmental regulation issues within established policies; acts with considerable
independence in setting priorities and obtaining solutions; issues violation notices; and performs other
work as -required.
A summary._ of .the duties and responsibilities for the position of Deputy City Attorney II is as follows:
Under -general direction, performs legal work involving a wide range of municipal and criminal law
topics; handles routine professional legal tasks; attends Meetings of various Boards and Commissions in
an advisory capacity; performs related work as required.
EMPLOYMENT OVERLAP
According to Fire Chief, John Frando, if Mark Rodriguez is promoted to Hazardous Materials Specialist,
performance appraisals would not be reviewed or conducted by either employee for the other;
neither employee would be -directly supervised by the other; and they would not report to each other
Within the chain -of command as they would be, assigned to different departments.
Nepotism considerations , may adversely affect future appointments; transfers or promotional
opportunities. =

Cushnyr is currently employed as aL Fire Prevention/Environment Officer I in the Bakersfield Fire
Department. Therefore, the issue of nepotism must be addressed and reviewed prior to promotion.
The following information has been compiled for.your review and determination as to whether
nepotism creates an adverse impact on supervision, safety, security or morale, or involves significant
potential for conflicts of interest, as determined by the Fire Civil Service Board.
SUMMARY OF DUTIES
A summary of the duties and responsibilities for the position of Fire Captain is as follows: Under direction,
this class is responsible for work of considerable difficulty involving supervisory and skilled firefighting
work in directing the activities of an engine or truck company; and performs other work as required.
A summary of the duties and responsibilities for the position of Fire Prevention/Environmental Officer I is
as follows: Under general supervision, as a prevention/environmental officer wearing a badge,
performs routine and difficult work requiring specializedenvironmental skills to secure compliance with
the California Fire Code, California Building Code, applicable sections of the Health and Safety Code,
Bakersfield Municipal Code, including other codes, ordinances, and standards. Work involves resolving
routine to difficult code enforcement issues within established policy and; performs other work as
required.
