(Phased) that consist of 945 single-family residential lots, one public park lot, one sump lot, and one canal
lot on approximately 240 acres. (Ward 7)

STAFF RECOMMENDATION:
Adopt Resolution and suggested findings APPROVING extension of time for Vesting Tentative Tract Maps
6746 through 6750 to expire on January 5, 2027.
SITE CHARACTERISTICS: A majority of the project sites are vacant land. A single-family residence,
agricultural land, and accessory structures are located within the boundaries of VTTM 6748. The northern
portion of VTTM 6749 and VTTM 6750 are agricultural land. Surrounding properties are developed as:
north – single family residences; east – vacant land; south – a single-family home and agricultural land;
and west – agricultural and vacant land.
BACKGROUND AND TIMELINE:
• September 13, 2006 –City Council approved a change in the zone district from A (Agricultural) to R-1
(One Family Dwelling) within the boundaries of VTTMs 6746, 6748, and 6749, and to R-1/PUD (One
Family Dwelling/Planned Unit Development) within the boundaries of VTTMs 6747 and 6750, upon
annexation from the County of Kern to the City (Ordinance No. 4376).

• June 7, 2007: The Bakersfield Planning Commission approved VTTMs 6746 through 6750 which were
scheduled to expire January 5, 2022. At that time, the Planning Commission also adopted a mitigated
negative declaration (Resolution No. 87-07).
• November 28, 2007 – City Council approved a change in the zone district from R-1/PUD (One Family
Dwelling/ Planned Unit Development) to R-2 (Limited Multiple Family Dwelling) within the boundaries
of VTTM 6747 and VTTM 6750 (Ordinance No. 4475).
• January 6, 2010 - Ashe No. 4 (Annexation 503) was annexed to the City Of Bakersfield. The project
sites were included as a portion of this annexation area.
• 2013-2015 - In response to the economic downturn and recession, VTTMs 6746 through 6750 received
a series of automatic extensions of time as authorized by the California State legislature to expire
January 5, 2019.
• February 21, 2019 - The Planning Commission approved a three-year extension of time for VTTMs
6746 through 6750 to expire January 5, 2022 (Resolution Nos. 22-19, 23-19,24-19,25-19, and 26-19)
• February 17, 2022 - The Planning Commission approved a three-year extension of time for VTTMs
6746 through 6750 to expire January 5, 2025 (Resolution Nos. 10-22,11-22, 12-22, 21-22, 22-22)
• December 2, 2024 - The applicant submitted a completed application requesting an extension of time
for VTTMs 6746 through 6750.
PROJECT ANALYSIS:
The proposed subdivisions are five contiguous Vested Tentative Tract Maps. For efficiency purposes, Staff
combined the five requests into one staff report since they share the same engineer, subdivider, property
owner, and similar development characteristics. For legal purposes, a separate resolution has been
prepared for each tentative tract map since the requests can be approved/denied on individual basis.
VTTM 6746 is located in the northeast portion of the five maps and consists of 154 lots on 39.79 acres
for purposes of single-family residential development. The typical residential lot is the lot size is
approximately 55 feet wide by 110 feet deep ( 6,050 square feet ), and the net density is 5.75 units per
net acre which is consistent with the LR designation of the project site of less than or equal to 7.26
dwelling units per net acre.
VTTM 6747 is located in the northwest portion of the five maps and consists of 192 lots on 40.75 acres
for purposes of single-family residential development. The typical residential lot is the lot size is
approximately 55 feet wide by 90 feet deep ( 5,218 square feet ), and the net density is 7.26 units per net
acre which is consistent with the LR designation of the project site of less than or equal to 7.26 dwelling
units per net acre.
VTTM 6748 is located in the central portion of the five maps and consists of 132 lots on 48.73 acres for
purposes of single-family residential development. The typical residential lot is the lot size is
approximately 65 feet wide by 120 feet deep (7,800 square feet ), and the net density is 5.02 units per
net acre which is consistent with the LR designation of the project site of less than or equal to 7.26
dwelling units per net acre.
VTTM 6749 is located in the southeast portion of the five maps and consists of 194 lots on 46.59 acres
for purposes of single-family residential development. The typical residential lot is the lot size is
approximately 55 feet wide by 110 feet deep ( 6,050 square feet ), and the net density is 6.23 units per
net acre which is consistent with the LR designation of the project site of less than or equal to 7.26
dwelling units per net acre.

VTTM 6750 is located in the southwest portion of the five maps and consists of 273 lots on 65.35 acres
for purposes of single-family residential development. The typical residential lot is the lot size is
approximately 55 feet wide by 90 feet deep ( 5,218 square feet ), and the net density is 7.23 units per net
acre which is consistent with the LR designation of the project site of less than or equal to 7.26 dwelling
units per net acre.
Extension of Time. The applicant is requesting a two-year extension to allow additional time to obtain
approval for the improvement plans and to record the final maps. Pursuant to Government Code Section
66452.26 (AB 2973), single-family or multi-family residential maps approved between January 1, 2006,
and July 11, 2013, which had their expiration date extended under Government Code Section 66452.25,
are eligible to apply for this extension.
Government Code Section 66452.26 (effective January 1, 2019) approved a 24-month extension of time
for approved tentative and vesting tentative tract and parcel maps meeting certain requirements,
including but not limited to the tentative map a) was approved between January 1, 2002 and July 11,
2013; b) located in a county where certain indicators such as substandard annual income, higher
unemployment rates, or higher poverty rate show the county economically disadvantaged. Kern County
meets some of those economic markers.
VTTMs 6746 through 6750 have sewer issues that need to be resolved in order to provide sewer services
to these tracts. Granting this extension will provide the developer with the additional time needed to
record the final maps for each phase of development. The applicant submitted a written request for the
extension before the expiration date of January 5, 2025.
Circulation. Access to VTTM 6746 will be from Ashe Road (arterial) on the subdivision’s east boundary and
future Romero Road (collector) on the south. One local street is proposed to be extended westerly
through this subdivision to provide circulation within the neighborhood.
Access to VTTM 6747 would be from Romero Road (collector) on the subdivision's south boundary. Four
local streets proposed to be extended to the west, east, north and south through this subdivision to
provide circulation within the neighborhood
Access to VTTM 6748 would be from Romero Road (collector) on the subdivision's north boundary. Six
local streets are proposed to be extended westerly and southernly through this subdivision to provide
circulation within the neighborhood.
Access to VTTM 6749 would be from Eberle Road (collector) on the subdivision's west boundary and from
future Romero Road (collector) on the north. Six local streets are proposed to be extended easterly and
westerly through this subdivision to provide circulation within the neighborhood.
Access to VTTM 6750 would be from Ashe Road (arterial) on the on the subdivision's east boundary and
from Engle Road (arterial) on the south. Four local streets are proposed to be extended westerly through
this subdivision to provide circulation within the neighborhood.
Compliance with Standards. The proposed project, subject to the original conditions of approval,
complies with the ordinances and policies of the City of Bakersfield.
ENVIRONMENTAL REVIEW AND DETERMINATION:
The extension of time request is not subject to the provisions of the California Environmental Quality Act
(“CEQA”) in accordance with Section 15061(b)(3) because the project [extension of time] will not result in
either a direct or a reasonably foreseeable indirect physical change in the environment.
PUBLIC NOTIFICATION:

Public notice for the proposed project and environmental determination was advertised in The Bakersfield
Californian and posted on the bulletin board in the City of Bakersfield Development Services Building,
1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were
notified by United States Postal Service mail regarding this public hearing in accordance with city
ordinance and state law.
Comments Received. As of this writing, no written public comments have been received.
CONCLUSIONS:
Recommendation. The applicant provided the applications for the Extension of Time in a timely manner
and the request adheres to the extensions permitted by Bakersfield Municipal Code 16.16.080. The
requested two-year extension will allow the developer additional time to record final map. Based on
information in the record, Staff recommends your Commission adopt Resolution and suggested findings
APPROVING the extension of time for Vesting Tentative Tract Maps 6747 through 6750 to expire on
January 5, 2027, with no changes to previously approved conditions of approval.

DRAFT RESOLUTION OF THE BAKERSFIELD PLANNING COMMISSION TO APPROVE AN EXTENSION OF TIME FOR VESTING TENTATIVE TRACT MAP 6746 (PHASED), LOCATED GENERALLY ON THE NORTHWEST CORNER OF ASHE ROAD AND FUTURE
ROMERO ROAD.
WHEREAS, McIntosh and Associates, representing Four B Properties, LLC, filed an
application with the City of Bakersfield Planning Department requesting an extension of time
for Vesting Tentative Tract Map 6746 (the “Project”) located in the City of Bakersfield as shown
on attached (Exhibit “A”); and
WHEREAS, the application was submitted on December 2, 2024, which is prior to the
expiration date of Vesting Tentative Map 6746, and in accordance with the provisions of Section
16.16.080 of the Bakersfield Municipal Code; and
WHEREAS, in accordance with Government Code Section 66452.26, the Applicant is
requesting a 24 month extension of time for the tentative map; and
WHEREAS, Government Code Section 66452.26 requires that the tentative maps for
single-family and multifamily housing meet criteria related to previously approved extensions
of time and county-wide economic indicators; and
WHEREAS, the original application of the tentative map was deemed complete on April 5, 2007, conditionally approved by the Planning Commission on June 7, 2007; and
WHEREAS, the Ashe No. 4 Environmental Impact Report (EIR) was previously certified by
the City Council on August 16, 2006 for Vesting Tentative Tract Map 6746; and WHEREAS, there have been no substantial changes to the Project or circumstances under which it will be undertaken; and
WHEREAS, no new environmental impacts have been identified; and
WHEREAS, the Project is exempt from the requirements of the California Environmental
Quality Act (CEQA), pursuant State CEQA Guidelines Section15061(b)(3), Common Sense
Exemption; and
WHEREAS, the Secretary of the Planning Commission set, Thursday, February 6, 2025, at
5:30 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for a public hearing before the Planning Commission to consider the
application, and notice of the public hearing was given in the manner provided in Title Sixteen
of the Bakersfield Municipal Code; and
WHEREAS, the facts presented in the staff report, environmental review evidence
received both in writing, and the verbal testimony at the above referenced public hearing
support the following findings:

1. All required public notices have been given. Hearing notices regarding the Project
were mailed to property owners within 300 feet of the Project area and published in the Bakersfield Californian, a local newspaper of general circulation, 10 days prior to
the hearing.
2. The provisions of the CEQA have been followed.
3. Pursuant to State CEQA Guidelines Section 15061 (b) (3), the activity (extension of
time) is not considered a project for purposes of CEQA. CEQA does not apply if the
activity [extension of time] will not result in either a direct or a reasonably foreseeable
indirect physical change in the environment.
4. This request for an extension of time is pursuant to Bakersfield Municipal Code Section
16.16.080 and Subdivision Map Act Section 66452.26.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Bakersfield
as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The project is exempt from CEQA, pursuant to CEQA Guidelines Section15061(b)(3),
Common Sense Exemption.
3. Vesting Tentative Tract Map 6746 meets the criteria as described in Government
Section 66452.26 that allows a 24-month extension of time.
4. The expiration date of Vesting Tentative Tract Map 6746 is hereby extended until January 5, 2027.

DRAFT RESOLUTION OF THE BAKERSFIELD PLANNING COMMISSION TO APPROVE AN EXTENSION OF TIME FOR VESTING TENTATIVE TRACT MAP 6747 (PHASED) LOCATED GENERALLY ¼ MILE WEST OF ASHE ROAD, NORTH OF FUTURE ROMERO
ROAD.
WHEREAS, McIntosh and Associates, representing Four B Properties, LLC, filed an
application with the City of Bakersfield Planning Department requesting an extension of time
for Vesting Tentative Tract Map 6747 (the “Project”) located in the City of Bakersfield as shown
on attached (Exhibit “A”); and
WHEREAS, the application was submitted on December 2, 2024, which is prior to the
expiration date of Vesting Tentative Map 6747, and in accordance with the provisions of Section
16.16.080 of the Bakersfield Municipal Code; and
WHEREAS, in accordance with Government Code Section 66452.26, the Applicant is
requesting a 24 month extension of time for the tentative map; and
WHEREAS, Government Code Section 66452.26 requires that the tentative maps for
single-family and multifamily housing meet criteria related to previously approved extensions
of time and county-wide economic indicators; and
WHEREAS, the original application of the tentative map was deemed complete on April 5, 2007, conditionally approved by the Planning Commission on June 7, 2007; and
WHEREAS, the Ashe No. 4 Environmental Impact Report (EIR) was previously certified by
the City Council on August 16, 2006 for Vesting Tentative Tract Map 6747; and WHEREAS, there have been no substantial changes to the Project or circumstances under which it will be undertaken; and
WHEREAS, no new environmental impacts have been identified; and
WHEREAS, the Project is exempt from the requirements of the California Environmental
Quality Act (CEQA), pursuant State CEQA Guidelines Section15061(b)(3), Common Sense Exemption; and
WHEREAS, the Secretary of the Planning Commission set, Thursday, February 6, 2025, at
5:30 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for a public hearing before the Planning Commission to consider the
application, and notice of the public hearing was given in the manner provided in Title Sixteen
of the Bakersfield Municipal Code; and
WHEREAS, the facts presented in the staff report, environmental review evidence
received both in writing, and the verbal testimony at the above referenced public hearing
support the following findings:

1. All required public notices have been given. Hearing notices regarding the Project
were mailed to property owners within 300 feet of the Project area and published in the Bakersfield Californian, a local newspaper of general circulation, 10 days prior to
the hearing.
2. The provisions of the CEQA have been followed.
3. Pursuant to State CEQA Guidelines Section 15061 (b) (3), the activity (extension of
time) is not considered a project for purposes of CEQA. CEQA does not apply if the
activity [extension of time] will not result in either a direct or a reasonably foreseeable
indirect physical change in the environment.
4. This request for an extension of time is pursuant to Bakersfield Municipal Code Section
16.16.080 and Subdivision Map Act Section 66452.26.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Bakersfield
as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The project is exempt from CEQA, pursuant to CEQA Guidelines Section15061(b)(3),
Common Sense Exemption.
3. Vesting Tentative Tract Map 6747 meets the criteria as described in Government
Section 66452.26 that allows a 24-month extension of time.
4. The expiration date of Vesting Tentative Tract Map 6747 is hereby extended until January 5, 2027.

DRAFT RESOLUTION OF THE BAKERSFIELD PLANNING COMMISSION TO APPROVE AN EXTENSION OF TIME FOR VESTING TENTATIVE TRACT MAP 6749 (PHASED) LOCATED GENERALLY ¼ MILE WEST OF ASHE ROAD, SOUTH OF FUTURE ROMERO
ROAD.
WHEREAS, McIntosh and Associates, representing Four B Properties, LLC, filed an
application with the City of Bakersfield Planning Department requesting an extension of time
for Vesting Tentative Tract Map 6749 (the “Project”) located in the City of Bakersfield as shown
on attached (Exhibit “A”); and
WHEREAS, the application was submitted on December 2, 2024, which is prior to the
expiration date of Vesting Tentative Map 6749, and in accordance with the provisions of Section
16.16.080 of the Bakersfield Municipal Code; and
WHEREAS, in accordance with Government Code Section 66452.26, the Applicant is
requesting a 24 month extension of time for the tentative map; and
WHEREAS, Government Code Section 66452.26 requires that the tentative maps for
single-family and multifamily housing meet criteria related to previously approved extensions
of time and county-wide economic indicators; and
WHEREAS, the original application of the tentative map was deemed complete on April 5, 2007, conditionally approved by the Planning Commission on June 7, 2007; and
WHEREAS, the Ashe No. 4 Environmental Impact Report (EIR) was previously certified by
the City Council on August 16, 2006 for Vesting Tentative Tract Map 6749; and WHEREAS, there have been no substantial changes to the Project or circumstances under which it will be undertaken; and
WHEREAS, no new environmental impacts have been identified; and
WHEREAS, the Project is exempt from the requirements of the California Environmental
Quality Act (CEQA), pursuant State CEQA Guidelines Section15061(b)(3), Common Sense
Exemption; and
WHEREAS, the Secretary of the Planning Commission set, Thursday, February 6, 2025, at
5:30 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as
the time and place for a public hearing before the Planning Commission to consider the
application, and notice of the public hearing was given in the manner provided in Title Sixteen
of the Bakersfield Municipal Code; and
WHEREAS, the facts presented in the staff report, environmental review evidence
received both in writing, and the verbal testimony at the above referenced public hearing
support the following findings:

1. All required public notices have been given. Hearing notices regarding the Project
were mailed to property owners within 300 feet of the Project area and published in the Bakersfield Californian, a local newspaper of general circulation, 10 days prior to
the hearing.
2. The provisions of the CEQA have been followed.
3. Pursuant to State CEQA Guidelines Section 15061 (b) (3), the activity (extension of
time) is not considered a project for purposes of CEQA. CEQA does not apply if the
activity [extension of time] will not result in either a direct or a reasonably foreseeable
indirect physical change in the environment.
4. This request for an extension of time is pursuant to Bakersfield Municipal Code Section
16.16.080 and Subdivision Map Act Section 66452.26.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Bakersfield
as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The project is exempt from CEQA, pursuant to CEQA Guidelines Section15061(b)(3),
Common Sense Exemption.
3. Vesting Tentative Tract Map 6749 meets the criteria as described in Government
Section 66452.26 that allows a 24-month extension of time.
4. The expiration date of Vesting Tentative Tract Map 6749 is hereby extended until January 5, 2027.
