RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD APPROVING AN APPLICATION OF MARION
COLLINS, MESA MARIN RACEWAY REQUESTING A
CONDITIONAL USE PERMIT TO EXPAND AN EXISTING OFFICE
AND RESCIND CONDITION 7.B. OF CONDITIONAL USE PERMIT
#5618 REGARDING INSTALLATION OF FENCING AND
LANDSCAPING (FILE NO. P97-0037).
WHEREAS, Marion Collins filed a written application with the City Council of the City of
Bakersfield requesting a Conditional Use Permit to expand an existing office by approximately
1,205 sq.ft., and to rescind condition 7.b. of Conditional Use Permit #5618 regarding installation
of fencing and landscaping (trees) along the west property line~ and
WHEREAS, said Council through its Clerk set February 19, 19957 at the hour of 7:00
p.m., in the Council Chamber of City Hall, Bakersfield, California, as the time and place for a
public hearing before said Council on said application, and notice of said heating was given in the
manner provided by Title Seventeen of the Municipal Code of the City of Bakersfield; and
WHEREAS, for the above-described project, an initial study was conducted and it was
determined that the proposed project would not have a significant effect on the environment and
the previous Negative Declaration approved on April 19, 1995 by the City Council adequately
addressed the project; therefore, no new Negative Declaration need be prepared; and
WHEREAS, the law and regulations relating to the preparation and adoption of Negative
Declarations as set forth in CEQA and City ofBakersfield's CEQA Implementation Procedures,
have been duly followed by city staff and the Board of Zoning Adjustment; and
WHEREAS, at said hearing held February 19, 1997, the application was duly heard and
considered, and the City Council found as follows:

The proposed project is both essential and desirable to the
public welfare in that it enhances an existing recreational use
by improving enclosed office area for use by the press and
racing officials. The condition for fencing and landscaping
is no longer necessary for buffering as the applicant owns
the adjacent 156 acre parcel.
2)
The proposed use is in harmony with the goals, objectives and policies of
the Metropolitan Bakersfield 2010 General Plan, and intent and purpose of
the City of Bakersfield's Zoning Ordinance. The proposal is compatible
and complimentary with previous uses approved on the site.
3) Public notice has been given pursuant to both city and state
regulations.
4)
The provisions of CEQA and the city's environmental
implementation procedures have been followed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD that said Conditional Use Permit as described above is hereby approved
subject to the applicant continuing to satisfy all remaining conditions imposed by Conditional Use
Permit #5618.
