APN: 528-010-36 PROJECT SIZE: 6.69 acres CEQA: Section 15164 (Addendum) EXISTING GENERAL PLAN DESIGNATION: SR (Suburban Residential) EXISTING ZONE CLASSIFICATION: E (Estate) STAFF RECOMMENDATION: The project site is predominantly vacant land. Surrounding properties are primarily developed as: north - single family residential and Veterans Elementary School; east - single family residential; south – CalWater well site and single family residential; and west – St. Elizabeth Ann Seton Church BACKGROUND AND TIMELINE: • January 28, 1998 – City Council approved the pre-zoning of property within the sphere of influence boundary. The project site was prezoned to E (Estate). At that time, the City Council also adopted a negative declaration (Ordinance No. 3819). ~ BAKERSFIELD TI-E SOOIO OF~ &I,, Vesting Tentative Tract Map 7492 • April 3, 2002 - The project site was annexed to the City of Bakersfield as part of Reina No. 3 Annexation (Annexation #425). • December 14, 2011: City Council approved Zone Change from an E (Estate) zone to an E-CH (Estate- Church) zone on 18.03 gross acres to facilitate church use located at the northwest corner of Reina and Old Farm Road. A mitigated negative declaration was also adopted (ZC 11-0271; Planning Commission Resolution No. 17-11 and Ordinance No. 4654). • March 4, 2021 – City Council approved Tentative Tract Map (TTM) 7383 which contained 24 single- family residential lots, one sump lot, and one remainder lot, on 26.08 acres. VTTM 7492 is located within the boundaries of TTM 7383 (Resolution No. 132-2021). • March 3, 2023- Tentative Tract Map 7383 expired. • January 7, 2025 – The application for Vesting Tentative Tract Map 7492 was deemed complete. PROJECT ANALYSIS: The proposed vesting tentative tract subdivision consists of 28 lots on 6.69 acres for purposes of single- family residential development. The residential lots range in size from 7,919 square feet to 10,474 square feet, and the typical lot size is 61 feet wide by 129 feet deep (7,925 square feet). The net density is 5.14 units per net acre which is consistent with the SR designation of the project site of less than or equal to 7.26 dwelling units per net acre. Consistency/Deviation from Design Standards. The applicant has requested one deviation from City standards as detailed below. Except as may otherwise be described in this staff report, the proposed project, subject to the conditions of approval, complies with the ordinances and policies of the City of Bakersfield. • Reverse corner lot along Dolcetto Street (public local street) for Lot 1(ref BMC 16.28.170.P) • Due to configuration of the lots and to allow for best usage of the property with uniform lot size - APPROVE Circulation. Access to this subdivision would be from Dolcetto Street (local) on the subdivision's east boundary and from Lavina Avenue (local) north of the subdivision. One local street (Dolcetto Street) is proposed to be extended through this subdivision to provide circulation within VTTM 7492. Park Land In-Lieu Fees/Dedication. North of the River provides park and recreational services to the project site. The nearest existing NOR park is Polo Community Park located approximately 0.6 miles south of the project site. Mineral Rights. The applicant will be providing signatures on the final map pursuant to BMC 16.20.060 A and 16.20.050 (Condition 19). The applicant submitted a letter stating that the California Department of Conservation’s Division of Geologic Energy Management (CalGEM) stated that the project site is beyond their administrative boundaries of any oil or gas fields. There are no known wells on the property and no known active operators of record. If a well is uncovered, the subdivider must consult with CalGEM regarding proper abandonment of the well, in accordance with the municipal code (Condition 20). ENVIRONMENTAL REVIEW AND DETERMINATION: Vesting Tentative Tract Map 7492 The California Environmental Quality Act (CEQA) Guidelines, Section 15164 (b) states that an Addendum to a previously adopted Mitigated Negative Declaration (MND) may be prepared if only minor technical changes or additions are necessary but none of the conditions described in Section 15162 calling for the preparation of subsequent EIR or supplemental Negative Declaration have occurred. Accordingly, the lead agency has determined that updating mitigation verbiage from the previously approved environmental document is considered a minor technical change pursuant to CEQA Section 15162. Therefore, the MND prepared for the original project (ZC 11-0271) has been amended and mitigation has been updated (Condition Nos. 21-27). PUBLIC NOTIFICATION: Public notice for the proposed project and environmental determination was advertised in The Bakersfield Californian and posted on the bulletin board in the City of Bakersfield Development Services Building, 1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were notified by United States Postal Service mail regarding this public hearing in accordance with city ordinance and state law. Signs are required as part of the public notification process and must be posted between 20 to 60 days before the public hearing date. Photographs of the posted signage and the Declaration of Posting Public Hearing Notice signed by the applicant are on file at the Planning Division. Comments Received. As of this writing, no written public comments have been received. CONCLUSIONS: Consistency with General Plan and Zoning Ordinance. The applicant has requested approval of VTTM 7492 to subdivide 6.69 acres into 28 single family residential lots ranging in size from 7,919 square feet to 10,474 square feet on property designated SR in a E (Estate) zone. The purpose of this request is to facilitate future residential development on an infill site. The proposal is consistent with land use goals and policies as contained in the General Plan, which encourages continuity of existing development and allows incremental expansion of infrastructure. Additionally, the proposed project is consistent with the Zoning Ordinance and any future development onsite will also be required to comply with all applicable regulations and design standards as identified in the Zoning Ordinance. Recommendation. Staff finds that the applicable provisions of CEQA have been complied with, and the proposal is compatible with the existing land use designation and land uses in the surrounding area. Based on information in the record, Staff recommends your Commission adopt the Resolution and findings APPROVING Vesting Tentative Tract Map 7492 as outlined in this staff report subject to the recommended conditions. CEQA Guidelines Section 15164 allows an addendum to a previously certified environmental document to be prepared if some changes or additions are necessary but none of the conditions described in CEQA Guidelines Section 15162 calling for the preparation of a subsequent document have occurred. The City of Bakersfield adopted a Mitigated Negative Declaration (MND) for Zone Change No. 11-0271 by Resolution No. 17-11. The MND for ZC 11-0271 is hereby amended by this Addendum for the VTTM 7492 as described below. LOCATION: Generally northwest of Reina Road and Old Farm Road in northwest Bakersfield (APN: 528-010-36) BACKGROUND: The MND for Zone Change No. 11-0271 was adopted by the City of Bakersfield on October 20, 2011 by Resolution No. 17-11. The MND included mitigation for the following categories: biological resources and cultural resources. CHANGES IN PROJECTS AND IMPACTS: The previous environmental analysis designated the current project area as future single family development, and no proposed subdivision, lot layout, or design was provided to staff for review at the time. The current proposal requests to subdivide and create 28 single-family residential estate size lots on the 6.69-acre parcel. The residential lots range in size from 7,919 square feet to 10,474 square feet, and the typical lot size is 61 feet wide by 129 feet deep (7,925 square feet). The proposed project will complement and harmonize with the character of the surrounding neighborhood and community. The project site is depicted as SR (Suburban Residential) on the Land Use Element of the Metropolitan Bakersfield General Plan. The proposed VTTM 7492 is zoned E (Estate) which is consistent with the land use designation within the Metropolitan Bakersfield General Plan and the existing land uses. The previous MND for Zone Change No. 11-0271, may be used to fill the environmental review requirements for the proposed VTTM 7492. The mitigation measures for VTTM 7492 have been updated to reflect current standards. Please see the attached Mitigation Measures for reference. These changes are considered minor technical changes per CEQA Section 15164. There are no substantial changes with respect to the circumstances under which the tract map is undertaken that require major revisions to the previous MND due to the involvement of new environmental effects. Likewise, there is no new information of substantial importance that results in new significant effects. FINDING: The previous MND for Zone Change No. 11-0271, as amended by this Addendum, may be used to fill the environmental review requirements for the proposed VTTM 7492. The mitigation measures have been updated to reflect current standards and it has been determined that the request would not result in significant impacts on any environmental subject areas requiring analysis under CEQA. The subdivider is required to comply directly with requests of the U.S. Fish and Wildlife Service (USFWS) and the California Department of Fish and Wildlife (CDFW). Orderly development. 2. Prior to ground disturbance, the subdivider shall have a qualified consultant survey the location for burrowing owl, and comply with the provisions of the Migratory Bird Treaty Act (MBTA) of 1918 (16 U.S.C. 703-711).
