SITE CHARATERISTICS: The project is located on a 1,915 square foot undeveloped portion of a 6.25-acre parcel with an existing church. Surrounding properties are developed as: north – residential and commercial; east – residential; south – residential; and west – residential ~ BAKERSFIELD TI-E SOOIO OF~ &I,, DRA 24-0003 Page 2 BACKGROUND AND TIMELINE: • June 16, 1969 - City Council approved an amendment to Annexation to the City, known as Stockdale No. 3 Annexation (Ordinance. No. 1804). PROJECT ANALYSIS: The proposed project site is located on the west side of Stine Road, south of Wilson Road and northwest of Hahn Avenue on Stine Road. The predominant zoning near the subject site is designated as residential zoned R-1 (Single-Unit Dwelling), R-2 (Small Lot Single-Unit Dwelling), and R-3 (Medium Density Multi- Unit Dwelling) with commercial parcels C-O (Professional and Administrative Office Zone) and C-1 (Neighborhood Commercial zone) to the east and north, respectively. Pursuant to Bakersfield Municipal Code Section 17.59.020.B.8, wireless communication facilities that are located on property zoned or designated residential, unless otherwise provided by the code, are subject to a Director Review and Approval (DRA) Permit. As previously noted, this project site is located in an area zoned and designated as residential. DRA Permits can be considered at the Director’s public hearing or referred to the Planning Commission for consideration. Due to wireless facilities often being controversial, it was determined this DRA would be referred to the Planning Commission. Proposed Development: The applicant is seeking approval for the development of a 65-foot tall monoeucalyptus camouflaged/stealth unmanned wireless telecommunications facility, along with ancillary equipment. The project consists of a new 65-foot Monoeucalyptus structure that will accommodate up to three (3) wireless carriers and the proposed installation of twelve (12) T-Mobile antenna and associated equipment. Equipment and towers shall be set back 50 feet from any public or private street, and 50 feet from adjacent lots zoned or designated residential. The project equipment compound will be surrounded by an 8-foot-tall, concrete masonry block wall to enclose a 1,915 square foot area. The project site is accessed from Stine Road along an existing paved driveway, extending from the property entrance to the tower. The primary objective of this telecommunications facility is meant to substantially enhance and expand the wireless coverage to both local and the surrounding area(s) without implementing significant or invasive aesthetic alterations. The specific goals of this project include: 1. Improved Service: The facility aims to provide coverage and expand the wireless service into an area that either has no service or bad service. 2. Increased Capacity: By deploying this telecommunications facility, it allows for more wireless resources. 3. Meeting Anticipated Demand: With the ever-increasing demand for wireless connectivity, the project aims to ensure that there is sufficient capacity to meet the expected demand from customers in the vicinity. 4. Preventing Overload Service: The facility should help prevent network overload during peak usage DRA 24-0003 Page 3 times, ensuring that users can access reliable and fast wireless service even during periods of high demand. 5. Reducing Dropped Calls: One of the common issues with inadequate wireless coverage is dropping calls. This project seeks to minimize this problem, enhancing the overall user experience. As outlined above and noted in the Operational Letter, dated October 1, 2024, the improvement in cell coverage and capacity will have a significant impact on the businesses and residents in the surrounding community. Further, the placement of a wireless facility on this lot will improve the public health and safety of the community in that it provides a reliable means to make phone calls in an emergency in the area of Bakersfield. Being consistent with the General Plan, the proposed facility will meet the needs of the community by upgrading the infrastructure to benefit wireless connectivity and service for the City’s residents within the project area. Compliance with Development Standards. The project is also subject to the following standards: Setbacks. Equipment buildings and towers shall be set back 50 feet from any public or private street, and 50 feet from adjacent lots zoned or designated residential. The nearest adjacent lot zoned or designated residential is located approximately one hundred fifty (150’) feet west of the project site. Enclosure. Use of underground vaults, landscaping, or other camouflaging completely screening equipment is encouraged and may be considered by the approving authority in lieu of a building. If security fencing is used, it shall be wrought iron or similar decorative material. Chain-link fencing may only be used if screened with landscaping. Equipment buildings shall not exceed a height of 12 feet and an area of 750 square feet. As proposed, the project equipment compound will be surrounded by an 8-foot-tall, concrete masonry block wall to enclose a 1,915 square foot area. No generator has been proposed for this project and no work is being proposed in the public right-of-way. The project site is accessed from Stine Road along an existing paved driveway, extending from the property entrance to the tower. Height. The maximum height for a wireless facility on property zoned or designated residential is 65 feet or no more than 20% above the existing height of adjacent natural objects, whichever is less. Natural objects do not include fabricated structures such as buildings, signs, utility poles/towers, or other telecommunication towers. The proposal will consist of a new 65-foot Monoeucalyptus structure that will accommodate up to three (3) wireless carriers and the proposed installation of twelve (12) T-Mobile antenna and associated equipment. Therefore, the development and design standards allow for a maximum height of sixty-five feet or no more than twenty percent above the existing height of adjacent natural objects, whichever is less. As proposed, the stand-alone Monoeucalyptus structure will be 65 feet tall and camouflaged as a eucalyptus tree to blend with the surrounding area. Distance Separation. Camouflaged Monoeucalyptus wireless communication tower shall be located no closer than 300 feet apart. Co-location is encouraged to minimize the number of antennas and towers in an area. The proposed location is approximately 1,700 feet from the nearest wireless communications facility, located at 3232 Stine Road. Other Standards. As proposed, the facility adheres to all other development and design standards including camouflage (stand-alone monoeucalyptus structure camouflaged as a eucalyptus tree, pine tree, or other natural object), security lighting, signs, colors, Federal Aviation Administration conformance, proper state of appearance, and interference with any electrical equipment in the surrounding DRA 24-0003 Page 4 neighborhoods. The stand-alone slim-line stealth monoeucalyptus structure will require a flush-mounted vertical antenna employing the latest stealth design features. A slim line stealth monoeucalyptus shall measure no more than 24 inches in diameter at the base that tapers smaller towards the top. The maximum distance of antenna arrays projecting from the pole shall not exceed eighteen inches. The monoeucalyptus tower shall be constructed and maintained to emulate, to the greatest extent feasible, the natural appearance of a eucalyptus tree with respect to, trunk design, branch and density, and branch taper. All branches shall be arranged in a natural order with the widest branches at the lowest portion of the monoeucalyptus tapering to the shortest branches at the top of the monoeucalyptus (Condition B.1). Nonetheless, should the Planning Commission approve the proposed request, the applicable standards are incorporated as conditions of approval. ENVIRONMENTAL REVIEW AND DETERMINATION: This project has been found to be exempt from the provisions of the California Environmental Quality Act (CEQA) and the City of Bakersfield’s CEQA Implementation Procedures in accordance with Section 15332 (Class 32: In Fill Development). This exemption includes projects that consist of an in-fill development project that does not have the potential to have a significant effect on the environment. A Notice of Exemption has been prepared. PUBLIC NOTIFICATION: Public notice for the proposed project and environmental determination was advertised in The Bakersfield Californian and posted on the bulletin board in the City of Bakersfield Development Services Building, 1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were notified by United States Postal Service mail regarding this public hearing in accordance with city ordinance and state law. Signs are required as part of the public notification process and must be posted between 20 to 60 days before the public hearing date. Photographs of the posted signage and the Declaration of Posting Public Hearing Notice signed by the applicant are on file at the Planning Division. Comments Received. As of this writing, no written public comments have been received. CONCLUSIONS: Findings. Bakersfield Municipal Code (B.M.C.) Section 17.64.060.D contains specific findings that must be made for your Commission to approve the requested Director Review and Approval Permit. Specifically, the section states that a Director Review and Approval Permit shall be granted only when it is found that: 1. The proposed use is deemed essential or desirable to the public convenience or welfare; and 2. The proposed use is in harmony with the key elements and objectives of the general plan and applicable specific plans. The municipal code also states that conditions as deemed appropriate or necessary to assure compliance with the intent and purpose of the zoning regulations and the various elements and objectives of the DRA 24-0003 Page 5 general plan and applicable specific plans and policies of the city or to protect the public health, safety, convenience, or welfare. As of this writing, no evidence has been presented to demonstrate that adverse impacts are anticipated to result from the Applicant’s request. Therefore, in accordance with the required findings, and as conditioned, Staff finds: (1) the proposal would not result in any detrimental impacts to the public welfare or to properties or improvements in the zone or vicinity in which the project is located; (2) the proposal will allow appropriate improvements on the site and add value to the property and area; and (3) the proposal would be consistent with the purposes and intent of the Bakersfield Zoning Ordinance. Recommendation. Staff finds that the applicable provisions of CEQA have been complied with, and the proposal sufficiently demonstrates compliance with the necessary findings. Therefore, staff recommends your Commission adopt Resolution and suggested findings APPROVING Director Review and Approval Permit No. 24-0003 with conditions of approval. ATTACHMENTS: Map Set • Aerial • Zone Classification • General Plan Designation Development Plans • Site Plan • Equipment Plan • Elevations • Topographic Survey • Rendition Photos • Coverage Predictions Operational Statement Letter of Justification Resolution with Exhibits RESOLUTION NO. ______ RESOLUTION OF THE BAKERSFIELD PLANNING COMMISSION APPROVING A DIRECTOR REVIEW AND APPROVAL PERMIT TO ALLOW A 65-FOOT TALL MONOEUCALYPTUS WIRELESS TELECOMMUNICATION FACILITY WITH ANCILLARY EQUIPMENT (MUNICIPAL CODE 17.59) IN A R-1 (SINGLE-UNIT DWELLING) ZONE DISTRICT, LOCATED AT 3001 STINE ROAD (DIRECTOR REVIEW AND APPROVAL PERMIT NO. 24-00003) WHEREAS, Tower Co. and T-Mobile representing Fellowship Babtist Church of Bakersfield (property owner), filed an application with the City of Bakersfield Development Services Department for a Director Review and Approval Permit to allow a 65-foot tall monoeucalyptus wireless telecommunications facility with ancillary equipment (BMC 17.59) in an R-1 (Single-Unit Dwelling) zone district, located at 3001 Stine Road (the “Project”); and WHEREAS, the Secretary of the Planning Commission set Thursday, March 20, 2025, at 5:30 p.m. in City Council Chambers, City Hall South, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before the Planning Commission to consider the proposed conditional use permit, and notice of the public hearing was given in the manner provided in Title 17 of the Bakersfield Municipal Code; and WHEREAS, at the public hearing (no testimony was received either in support or opposition of the Project) (testimony was received only in support/opposition/both in support and opposition of the Project); and WHEREAS, the laws and regulations relating to the California Environmental Quality Act (CEQA) and the City of Bakersfield's CEQA Implementation Procedures have been duly followed by city staff and the Planning Commission; and WHEREAS, the above described project is exempt from the requirements of CEQA in accordance with Section 15332; and WHEREAS, the City of Bakersfield Development Services Department (1715 Chester Avenue, Bakersfield, California) is the custodian of all documents and other materials upon which the environmental determination is based; and WHEREAS, the facts presented in the staff report and evidence received both in writing and by verbal testimony at the above referenced public hearing support the following findings: 1. All required public notices have been given. Hearing notices regarding the Project were mailed to property owners within 300 feet of the Project area and published in The Bakersfield Californian, a local newspaper of general circulation, 10 days prior to the hearing. 2. The provisions of CEQA, the State CEQA Guidelines, and the City of Bakersfield CEQA Implementation Procedures have been followed. Staff determined that the proposal is a project that is exempt from CEQA pursuant to Section 15332 because the project that consist of an in-fill development project that does not have the potential to have a significant effect on the environment. A Notice of Exemption has been prepared. The proposed use is essential and desirable to the public convenience and welfare. 4. The proposed use is in harmony with the various elements and objectives of the Metropolitan Bakersfield General Plan. 5. The project would result in a development that is consistent with the intent of both the Metropolitan Bakersfield General Plan and the Bakersfield Municipal Code. NOW, THEREFORE, BE IT RESOLVED by the Bakersfield Planning Commission as follows: 1. The above recitals, incorporated herein, are true and correct. 2. This project is exempt from the requirements of CEQA. 3. Director Review and Approval Permit No. 24-0003 as described in this resolution, is hereby approved subject to the conditions of approval in Exhibit A and as shown in Exhibits B and C. Site Plan EXHIBIT A CONDITIONS OF APPROVAL Director Review and Approval No. 24-0003 I.The applicant's rights granted by this approval are subject to the following provisions: •The project shall be in accordance with all approved plans, conditions of approval, and other required permits and approvals. All construction shall comply with applicable building codes. •All conditions imposed shall be diligently complied with at all times and all construction authorized or required shall be diligently prosecuted to completion before the premises shall be used for the purposes applied for under this approval. •This approval will not be effective until ten (10) days after the date upon which it is granted by the Planning Commission to allow for appeal to the City Council. Any permit or license for any approval granted shall not be issued until that effective date. •This approval shall automatically be null and void two (2) years after the effective date unless the applicant or successor has actually commenced the rights granted, or if the rights granted are discontinued for a continuous period of one (1) year or more. This time can be extended for up to one (1) additional year by the approving body. •The Planning Commission may initiate revocation of the rights granted if there is good cause, including but not limited to, failure to comply with conditions of approval, complete construction or exercise the rights granted, or violation by the owner or tenant of any provision of the Bakersfield Municipal Code pertaining to the premises for which the approval was granted. The Planning Commission may also consider adding or modifying conditions to ensure the use complies with the intent of City ordinances. •Unless otherwise conditioned, this approval runs with the land and may continue under successive owners provided all the above-mentioned provisions are satisfied. III.The following are specific items that you need to resolve before you can obtain a building permit or be allowed occupancy. These items include conditions and/or mitigation required by previous site entitlement approvals (these will be specifically noted), changes or additions that need to be shown on the final building plans, alert you to specific fees, and other conditions for your project to satisfy the City’s development standards. The items listed below will usually need to be shown on the final building plans or completed before a building permit is issued.
