STAFF RECOMMENDATION: Adopt Resolution and suggested findings APPROVING extension of time for
Vesting Tentative Parcel Map 11698 to expire on April 2, 2027.
SITE CHARACTERISTICS: The project site is vacant land. Surrounding properties are developed as: north
-vacant land; east-two single family homes and vacant land; south -single-family residential; and west
-vacant land.

BACKGROUND AND TIMELINE:
• September 12, 1977-Rio Bravo Annexation was annexed to the City of Bakersfield. This project site
was included as a portion of this annexation area (Annexation 240).
• January 25, 2006-City Council approved Zone Change No. 05-0341 to change the zone classification
from R-S 2.5 acre (Residential Suburban 2.5-acre lot minimum) to R-1 {One Family Dwelling) on the
northern 20 acres; and R-S 2.5 acre to C-2 (Regional Commercial) on the southern 20 acre portion of
the tentative parcel map. At that time, the City Council also adopted a mitigated negative declaration.

• March 2, 2006 -Vested Tentative Tract Map 6730 is approved for a single-unit residential
development on the northern half of this parcel map (APN 386-210-32). VTTM 6730 is scheduled to
expire on July 31, 2025. (Resolution 51-06)
• October 10, 2007 -City Council approved General Plan Amendment/Zone Change No. 06-2254 to
change the land use designation from LR (Low Density Residential) to HMR (High Medium Density
Residential), and from R-1 (One Family Dwelling) to R-2/PUD (Limited Multiple Family
Dwelling/Planned Unit Development) on the northern 20 acres of this VTPM 11698. {Resolution 183-
07 and Ordinance No. 4466)
• April 3, 2008 -The Planning Commission approved Vesting Tentative Parcel Map (VTPM) No. 11698.
(Resolution No. 54-08).
• April 18, 2019 -The Planning Commission approved the first three-year extension of time for VTPM
11698 which was scheduled to expire on April 2, 2022. (Resolution No. 47-19)
• June 2, 2022 -The Planning Commission approved a second three-year extension of time for VTPM
11698 to expire April 2, 2025 (Resolution No. 54-22).
• February 14, 2025-The applicant submitted a completed application requesting an extension of time
for VTPM 11698 in accordance with Government Code 66452.26 (AB 2973, effective January 1, 2019).
PROJECT ANALYSIS:
The vesting tentative parcel subdivision consists of 4 lots and one sump on 40 acres for purposes of multi-
unit residential development (northerly 20 acres) and commercial development (southerly 20 acres).
There is a 2-acre drill site reserved in the southeastern portion of this subdivision.
Extension of Time. The applicant is requesting a two-year extension to allow additional time to obtain
approval for improvement plans and to record final maps. Pursuant to Government Code Section (GC)
66452.26 (AB 2973, effective January 1, 2019), single-family or multi-family residential maps approved
between January 1, 2006 and July 11, 2013, which had their expiration date extended under Government
Code Section 66452.25, are eligible to apply for this extension.
Government Code Section 66452.25 (effective January 1, 2019) allows a 24-month extension of time for
approved tentative and vesting tentative tract and parcel maps meeting certain requirements, including
but not limited to the tentative map a) was approved between January 1, 2006 and July 11, 2013; b)
located in a country where certain indicators such as substandard annual income, higher unemployment

rates, or higher poverty rate show the county as economically disadvantaged. Kern County meets some
of those economic markers.
The applicant is requesting a two-year extension to allow additional time to record final maps. No phase
of this map has been recorded. The applicant requested the extension of time prior to the April 2, 2025
expiration date.
Circulation. Access to this subdivision would be from Paladino Drive (arterial) on the subdivision's
southern boundary and from Rivani Drive (collector) that traverses north-south bisecting the property.
Compliance with Standards. The proposed project, subject to the original conditions of approval,
complies with the ordinances and policies of the City of Bakersfield.
ENVIRONMENTAL REVIEW AND DETERMINATION:
The extension of time request is not subject to the provisions of the California Environmental Quality Act
("CEQA") in accordance with Section 15061(b)(3) because the project [extension of time] will not result in
either a direct or a reasonably foreseeable indirect physical change in the environment.
PUBLIC NOTIFICATION:
Public notice for the proposed project and environmental determination was advertised in The Bakersfield
Californian and posted on the bulletin board in the City of Bakersfield Development Services Building,
1715 Chester Avenue, Bakersfield, California. All property owners within 300 feet of the project site were
notified by United States Postal Service mail regarding this public hearing in accordance with city
ordinance and state law.
Comments Received. As of this writing, no written public comments have been received.
CONCLUSIONS:
Recommendation. The applicant provided the application for the Extension of Time in a timely manner
and the request adheres to the extensions permitted by Bakersfield Municipal Code 16.16.080. The
requested two-year extension will allow the developer additional time to record the final map. VTPM
11698 has met the criteria provided in GC Section 66452.25 and 66452.26 to request the two-year
extension. Based on information in the record, Staff recommends your Commission adopt Resolution and
suggested findings APPROVING the extension of time for Vesting Tentative Parcel Map 11698 to expire
on April 2, 2027 with no changes to previously approved conditions of approval.

RESOLUTION NO.
RESOLUTION OF THE BAKERSFIELD PLANNING
COMMISSION TO APPROVE AN EXTENSION OF TIME FOR
VESTING TENTATIVE PARCEL MAP 11698 (PHASED)
LOCATED ON THE NORTH SIDE OF PALADINO DRIVE, AND
BOTH SIDES OF RIVANI DRIVE IN NORTHEAST BAKERSFIELD.
DRAFT
WHEREAS, McIntosh and Associates, representing Steve Boneso, filed an application with the City of
Bakersfield Planning Department requesting an extension of time for Vesting Tentative Parcel Map 11698 (the
"Project") located north of Paladino Drive, and both sides of Rivani Drive as shown on attached (Exhibit "A"); and
WHEREAS, the application was submitted on February 14, 2025, which is prior to the expiration date of
Vesting Tentative Parcel Map 11698, and in accordance with the provisions of Section 16.16.080 of the Bakersfield
Municipal Code; and
WHEREAS, in accordance with Government Code Section 66452.26, the Applicant is requesting a 24-
month extension of time for the tentative map; and
WHEREAS, Government Code Section 66452.26 requires that the tentative maps for single-family and
multifamily housing meet criteria related to previously approved extensions of time and county-wide economic
indicators; and
WHEREAS, the original application of the tentative map was deemed complete on February 8, 2008,
conditionally approved by the Planning Commission on April 3, 2008; and
WHEREAS, a Mitigated Negative Declaration was previously approved by the Planning Commission on
January 25, 2006, in conjunction with Project No. Zone Change 05-0341 for Vesting Tentative Parcel Map 11698;
and
WHEREAS, there have been no substantial changes to the Project or circumstances under which it will be
undertaken; and
WHEREAS, no new environmental impacts have been identified; and
WHEREAS, the Project is exempt from the requirements of the California Environmental Quality Act
(CEQA), pursuant State CEQA Guidelines Section15061(b)(3), Common Sense Exemption; and
WHEREAS, the Secretary of the Planning Commission set, Thursday, March 20, 2025 at 5:30 p.m. in the
Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public
hearing before the Planning Commission to consider the application, and notice of the public hearing was given
in the manner provided in Title Sixteen of the Bakersfield Municipal Code; and
WHEREAS, the facts presented in the staff report, environmental review evidence received both in
writing, and the verbal testimony at the above referenced public hearing support the following findings:

1. All required public notices have been given. Hearing notices regarding the Project were mailed to!
property owners within 300 feet of the Project area and published in the Bakersfield Californian, a: •
local newspaper of general circulation, 10 days prior to the hearing.
2. The provisions of the CEQA have been followed.
3. Pursuant to State CEQA Guidelines Section 15061 (b) (3), the activity (extension of time) is not
considered a project for purposes of CEQA. CEQA does not apply if the activity [extension of time]
will not result in either a direct or a reasonably foreseeable indirect physical change in the •
environment.
4. This request for an extension of time is pursuant to Bakersfield Municipal Code Section 16.16.080 and
Subdivision Map Act Section 66452.6 (e).
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Bakersfield as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The project is exempt from CEQA, pursuant to CEQA Guidelines Section15061(b)(3), Common Sense)
Exemption.
3. Vesting Tentative Parcel Map 11698 meets the criteria as described in Government Section 66452.26'
that allows a 24-month extension of time.
4. The expiration date of Vesting Tentative Parcel Map 11698 is hereby extended until April 2, 2027.
