RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD REVERSING THE BOARD OF ADJUSTMENT'S
DECISION TO APPROVE A 1-YEAR EXTENSION OF TIME TO
COMMENCE CONSTRUCTION OF A COMMUNITY
CORRECTIONS/BOOKING FACILITY GRANTED A CONDITIONAL
USE PERMIT (FILE NO. P95-0017).
WHEREAS, Alternative Programs Inc. filed an application with the City of Bakersfield
Planning Department requesting a l-year extension of time to a conditional use permit approved
for a community corrections/booking facility. The proposal is located at 650 Oswell Street and is
within a M-2 (General Manufacturing) zone district; and
WHEREAS, said Board of Zoning Adjustment through its Secretary set January 28, 1997,
at the hour of 3:00 p.m., in the Council Chamber of City Hall, Bakersfield, California, as the time
and place for a public hearing before said Board on said extension, and notice of said heating was
given in the manner provided by Title Seventeen of the Municipal Code of the City of Bakersfield;
and
WHEREAS, at said hearing, the extension was duly heard and considered, and the Board
of Zoning Adjustment approved the extension of time for a one year period; and
WHEREAS, a timely appeal was filed by Roy Malohowski with the Clerk of the City
Council; and
WHEREAS, the City Council through its Clerk set March 26, 1997, at the hour of 7:00
p.m., in the Council Chamber of City Hall, Bakersfield, California, as the time and place for a
public hearing before said Council on said appeal, and notice of said hearing was given in the
manner provided by Title Seventeen of the Municipal Code of the City of Bakersfield; and
WHEREAS, at said hearing held March 26, 1997, the appeal was duly heard and
considered.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF BAKERSFIELD that the decision of the Board of Zoning Adjustment is reversed and the
extension of time to Conditional Use Permit P95-0017 is hereby denied.
