A RESOLUTION MAKING FINDINGS, APPROVING NEGATIVE
DECLARATION AND ADOPTING TEXT CHANGE
AMENDMENT TO THE RIVERLAKES RANCH SPECIFIC PLAN.
(SPECIFIC PLAN AMENDMENT NO. P96-0494).
WHEREAS, the Planning Commission of the City of Bakersfield, in accordance
with the provisions of the RiverLakes Ranch Specific Plan, held a public hearing on MONDAY,
FEBRUARY 3, 1997, and THURSDAY, FEBRUARY 6, t997, on the proposed text change
amendment to the RiverLakes Ranch Specific Plan, notice of the time and place of hearing
having been given at least twenty-one (21) calendar days before said hearing by publication in
the Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, such proposed text change amendment to the RiverLakes Ranch
Specific Plan is as follows:

General Provisions -

All commercial uses shall require development plan review and approval in
accordance with the City of Bakersfield Zoning Ordinance provisions. A master
development plan shall be prepared for development of land designated as
Major Commercial.

All commercial uses shall require development plan review and approval in
accordance with the City of Bakersfield Zoning Ordinance provisions. The land
designated as Major Commercial (121 + acres total) shall be planned in three
phases, maximum, and approved in the same manner as a Planned Commercial
Development as specified in the City Zoning Ordinance, Chapter 17.54.
WHEREAS, for the above-described Specific Plan Amendment, an Initial Study
was conducted, and it was determined that the proposed project would not have a significant
effect on the environment, and a Negative Declaration was prepared and posted on November
27, 1996, in accordance with CEQA; and
WHEREAS, on February 12, 1997, the decision of the Planning Commission
was appealed; and
WHEREAS, an appeal hearing and adoption of this Resolution was scheduled
before the City Council on March 26, 1997; and
WHEREAS, at said City Council hearing, the applicant withdrew his appeal and
spoke in support of the project; and
WHEREAS, there was no testimony in opposition presented; and
WHEREAS, the Council has considered the findings of the Planning Commission
and all appear to be true and correct; and
WHEREAS, the law and regulations relating to the preparation and adoption of
Negative Declarations as set forth in CEQA and City of Bakersfield's CEQA Implementation
Procedures have been duly followed by city staff and the Planning Commission; and
WHEREAS, by Resolution No. 5-97 on February 6, 1997, the Planning
Commission recommended approval and adoption of the Negative Declaration and proposed
text change amendment to the RiverLakes Ranch Specific Plan (Specific Plan Amendment No.
P96-0494) and this Council has fully considered the findings made by the Planning Commission
as set forth in that Resolution; and
WHEREAS, the Council has considered and hereby makes the following
findings:
1. All required public notices have been given.
2. The provisions of CEQA have been followed.
3. Based on an initial study, staff determined the proposed project will not
significantly affect the physical environment in the area and issuing a Negative Declaration is
adequate.
4. The proposed specific plan amendment is consistent with the
Metropolitan Bakersfield 2010 General Plan.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of
Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and correct.
2. The Negative Declaration for Specific Plan Amendment No. P96-0494 is
hereby approved and adopted.
3. The report of the Planning Commission, including maps and all reports and
papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City
Council, is hereby received, accepted and approved.
4. The City Council hereby approves and adopts the text change amendment to
the RiverLakes Ranch Specific Plan, consisting of the previously mentioned text changes for
Specific Plan Amendment No. P96-0494.
