A POLICY RESOLUTION OF THE COUNCIL
OF THE CITY OF BAKERSFIELD
DETERMINING THAT THE PURCHASE OF A
MAINTENANCE AGREEMENT AND LICENSE
ARE PROFESSIONAL SERVICES.
WHEREAS, the City is occasionally in need of obtaining computer
maintenance agreements and licenses to use software for new and replacement personal
computers; and
WHEREAS, a computer maintenance agreement and license to use software
is not an erection, improvement or a repair of public building nor the furnishing of supplies,
equipment, or materials, which would otherwise require application of bid procedures
pursuant to Bakersfield Municipal Code § 3.20.020; and
WHEREAS, a computer maintenance agreement and contract or a license
to use software is a contract for professional services subject to Bakersfield Municipal
Code § 3.20.105.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein by
reference and incorporated herein by reference.
2. The City Council finds as follows:
That a contract for a license to use software is a contract for
professional services; and
That a contract for a computer maintenance agreement is a
contract for professional services.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted
by the Council of the City of Bakersfield at a regular meeting thereof held on APE 2 $ 19~7
