HomeMy WebLinkAboutRES NO 79-97RESOLUTION NO. 7 9" 9 7 A RESOLUTION DETERMINING THAT AUTOMATED REFUSE AND GREENWASTE CARTS FOR EXPANSION OF THE CITY'S COLLECTION PROGRAM CANNOT REASONABLY BE OBTAINED THROUGH USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFORE, NOT TO EXCEED $330,000, AND TO PURCHASE THE CARTS. WHEREAS, the City has previously purchased over 60,000 automated refuse and greenwaste carts for its collection program from Toter Inc., and WHEREAS, the City completed implementation of its automation program utilizing said carts; and WHEREAS, the City entered Agreement No. 96-63 in March 1996 with Kern Refuse Disposal, Inc. (Hauling Contractor) to phase in automated residential refuse and greenwaste service; and WHEREAS, Agreement No. 96-63 provides that the City will furnish necessary greenwaste cans for the program to be implemented in areas served by Hauling Contractor; and WHEREAS, new homes in areas contiguous to those currently receiving automated refuse and greenwaste service require additional carts of the same design, size, color, parts and specification; and WHEREAS, the Finance Director has determined and has recommended that this Council find, that said carts can only reasonably be obtained from one vendor because of the compatibility with existing equipment and has recommended that this Council authorize dispensing with bidding therefor in accordance with Subsection D. 1 of Section 3.20.060 of the Bakersfield Municipal Code. NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: reference. The above recitals are true and correct and incorporated herein by 2. Said carts can only be reasonably obtained from one vendor because of the compatibility of said carts and the need to successfully integrate them into the existing City system. --Page I of 2 Pages-- 3. The Finance Director is authorized to dispense with bidding and to negotiate the purchase of same, with appropriation of funds from the Refuse Enterprise Fund ($70,000 budgeted and $260,000 from fund balance), not to exceed $330,000. .......... 000 ..........
