HomeMy WebLinkAboutRES NO 054-03RESOLUTION NO. 0 $ - 0 3 A RESOLUTION DETERMINING THAT POOL REPLASTERING AND RELATED WORK AT SILVER CREEK POOL IS OF URGENT NECESSITY FOR THE PRESERVATION OF LIFE, HEALTH AND PROPERTY AND AUTHORIZING AND EXCEPTION TO THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH FORMAL BIDDING THEREFOR, NOT TO EXCEED $100,000. WHEREAS, a recent inspection of the Silver Creek Recreational Pool and Wading Pool revealed the pools are in need of re-plastering and related work; and WHEREAS, California Administrative Code section 65535 requires public swimming pools be free from cracks and other defects as such defects may become a health hazard; and WHEREAS, Silver Creek swimming pool provides summer swim activities for over 7,400 citizens annually; and WHEREAS, it is necessary to accomplish the repairs to Silver Creek swimming pool in sufficient time to meet the needs of these citizens; and WHEREAS, the re-plastering and related work is necessary for the preservation of health; and WHEREAS, the City requires to have this work completed prior to scheduled pool opening on June 16, 2003, due to current pool use commitments; and WHEREAS, City forces are not experienced in this type of specialty work; and WHEREAS, under normal circumstances formal bids are required for projects estimated to be more than $25,000; and WHEREAS, with formal bidding procedures, the work might not be completed by scheduled pool opening on June 16, 2003; and C:\Documents and Settings~achriste. BAKERSFIELD\Local Settings\Temp\Replaste.doc -- Page 1 of 3 Pages -- NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. There is an urgent need to perform the re-plastering and related work for the preservation of life, health and property. 3. The work, supplies, equipment or materials can only be reasonably obtained within the specified time period from informal bidding of contractors specializing in this type of work and available to perform such work. 4. The Finance Director is authorized to dispense with formal bidding procedures, and negotiate the contract. 5. The Public Works Engineering Department is authorized to execute the contract. 6. The expenditure of funds for said work, supplies, equipment or materials shall not exceed One Hundred Thousand Dollars ($100,000). C:\Documents and Settings~achriste.
