HomeMy WebLinkAboutRES NO 063-01(1)RESOLUTION NO. 063-01 (1) AMENDMENT NO. 1 TO RESOLUTION NO. 063-01 ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2, DIVISION 28 (CALIFORNIA & R). WHEREAS, the City Council of the City of Bakersfield, heretofore by Resolution 063-01, adopted May 16, 2001, established Underground Utility District No. 2, Division 28 (California & R); and WHEREAS, no underground work has been done as of this date and the development plan within the proposed district has been changed; and WHEREAS, the City desires to phase the project and underground only those utilities within the area around the proposed aquatic center at this time. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield, that Resolution 063-01 is hereby amended as follows: BE IT RESOLVED that the district be phased, as described in Exhibit "A", and as shown on Exhibit "B', and hereby incorporated as a part of the Resolution. BE IT FURTHER RESOLVED that the Council does hereby fix January 15, 2004 as the date on which all affected utilities must have all facilities installed and have completed removal of ail poles, overhead wires and facilities for supplying electric, communication, cable television or similar or associated services within Phase 1 of Underground Utility District No. 2, Division 28. BE IT FURTHER RESOLVED that Rule 20.A conversion allocation funds shall be available for conversion of electric service panels, not to exceed fifteen hundred dollars ($1,500) per service entrance (excluding permit fees) to accept the new underground service facilities pursuant to the Public Utilities Commission of the State of California Advice Letter 1930-E. BE IT FURTHER RESOLVED that except as amended herein, all other terms and conditions of Resolution No. 053-01 shall remain in full force and effect. .......... 000 .......... B. & M., in the City of Bakersfield, County of Kern, State of California, being more particularly described as follows: Beginning at the intersection of the of the south right of way line of 13th Street (82.5 feet wide) and the east right of way line of O Street (82.5 feet wide); THENCE (1) Northerly along said east line of O Street, a distance of 775.5 feet, to the north line of vacated 15th Street; THENCE (2) Easterly along the north line of vacated 15th Street, a distance of 610.5 feet to a point on the west right of way line of Q Street; THENCE (3) Southerly and southwesterly along the west right of way line of the P Street, Q Street transition curve through various courses, a distance of 880 feet, more or less, to a point on the south right of way line of 13th Street THENCE (5) Westerly along the south right of way line of said 13th Street, a distance of 264 feet, more or less, to a point on the east right of way line of O Street and the TRUE POINT OF BEGINNING.
