RESOLUTION NO.
A RESOLUTION ADOPTING FEES AND
~ERVICE CHARGES PURSUANT TO THE
REVENUE/COST COMPARISON SYSTEM
UNDER CHAPTER 3.70 OF THE
BAKERSFIELD MUNICIPAL CODE
WHEREAS, Chapter 3.70 of the Bakersfield Municipal Code authorizes the
establishment and increase of Residential Solid Waste service charges under the revenue/cost
comparison system; and
WHEREAS, adoption of new and increased fees and charges, pursuant to Chapter 3.70
of the Bakersfield Municipal Code, is necessary for the City to recover the reasonable estimated
cost of providing the services for which the fees are charged; and
WHEREAS, a public hearing before the City Council was advertised twice in the
Bakersfield Californian, a newspaper of general circulation; and
WHEREAS, approximately 58,000 notices of the proposed rate adjustment and public
hearings on said adjustment were mailed to owners of record of all residential property in the City
&Bakersfield pursuant to Proposition 218 requirements; and
WHEREAS, in response to said notices and hearings, the City Clerk received 35 written
protests from said property owners; and
WHEREAS, the fees and charges set forth in Exhibit "A" attached hereto and
incorporated by reference as though fully set forth herein, do not exceed the reasonable estimated
cost of providing the services for which the fees are charged; and
WHEREAS, the means through which the City shall collect said fees shall be the County
property tax rolls.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals and findings are true and correct.
The fees and charges set forth in Exhibit "A", concerning service charges under
Chapter 3.70 of the Bakersfield Municipal Code are hereby adopted and shall
become effective on July 1, 1997.
