HomeMy WebLinkAboutRES NO 124-97RESOLUTION NO. 1 2 4 - 9 7 RESOLUTION AUTHORIZING THE CITY MANAGER TO FILE AN APPLICATION WITH THE NATIONAL PARK SERVICE, U.S. DEPARTMENT OF INTERIOR, TO ACQUIRE BAKERSFIELD FEDERAL BUILDING LOCATED AT 800 TRUXTUN AVENUE WHEREAS, certain real property owned by the United States, located in the County of Kern, State of California, has been declared surplus and at the discretion of the General Services Administration, may be assigned to the Secretary of the Interior for disposal for public park or recreation purposes, under the provisions of Section 203 (k) (2) of the Federal Property and Administrative Services Act of 1949 (63 Stat. 387), as amended, and rules and regulations promulgated pursuant thereto, more particularly described as follows: Bakersfield Federal Building located at 800 Truxtun Avenue in Bakersfield, California (GSA Control No. 9-G-CA-1478). Property consists of a three-story building totaling approximately 54,590 square feet situated on 1.60 acres; and WHEREAS, the City of Bakersfield, according to national standards, fails well short of the facilities needed to offer a balanced recreation program; and WHEREAS, said Federal property can be readily converted to a multi-purpose community recreation center to meet community needs; and WHEREAS, the provisions of the Federal Property and Administrative Services Act of 1949 (63 Stat. 387) as amended, will allow the City to acquire said property at a public benefit discount for recreation purposes at little or no cost to the City; and WHEREAS, the City of Bakersfield, needs and will utilize said property in perpetuity for a multi-purpose community recreation center as set forth in its application and in accordance with the requirements of said Act and the rules and regulations promulgated thereunder; and NOW, THEREFORE, BE IT RESOLVED BY the Council of the City of Bakersfield as follows: 1. The above recitals, incorporated herein, are true and correct. The City of Bakersfield shall make application to the Secretary of the Interior for transfer to the City of the Federal Building, located at 800 Truxtun Avenue, for use as a multi-purpose community recreation center and subject to such exceptions, reservations, terms, covenants, agreements, conditions, and restrictions as the Secretary of the Interior, or his/her authorized representative, may require in connection with the disposal of said property under said Act and the rules and regulations issued pursuant thereto. ORIGINAL Page 2 The City of Bakersfield has legal authority to acquire and manage the property and is willing and in position to assume immediate care and maintenance of the property. The City Manager is hereby authorized, for and on behalf of the City of Bakersfield, to perform any and all acts necessary to carry out the acquisition of said property, including the preparing, making, and filing of plans, applications, reports, and other documents, the execution, acceptance, delivery, and recordation of agreements, deeds, and other instruments pertaining to the transfer of said property, including the filing of copies of the application and the conveyance documents in the records of the governing body. The City of Bakersfield shall be responsible for payment of any and all sums necessary on account of the purchase price thereof or fees or costs incurred in connection with the transfer of said property for survey, title searches, recordation or instruments, or other costs identified with the Federal surplus property acquisition.
