NOTICE OF RIGHT TO APPEAL
Any person may appeal a decision of the Development Services Director. The appeal must be
filed in writing within 10 days from date of the Director's hearing setting forth the precise basis and
issues for the appeal. The appeal is limited to a determination of whether or not an adopted
development standard, zoning regulation or policy applied, or not applied, was done consistent
with the authority granted by city ordinance, or to address specific environmental mitigation; appeal
of the use without this information will not be accepted. The appeal must be addressed to the City
Planning Commission, c/o Planning Director; 1715 Chester Avenue; Bakersfield, CA 93301.
Appellants, except those within the public notice area, must include a $334 non-refundable filing
fee with the appeal. In addition, the Commission's decision may also be appealed to the City
Council following the same procedure, in writing, to the City Clerk. If all appeals are withdrawn
before the Planning Commission's meeting, they will not hear the item and the Director's decision
will become final.
The City will not issue any permit, license or other approval for a use involved in an application
until after all appeal periods have closed. If the Planning Commission does not receive an appeal
within the 10-day period, the Director's decision will become final.
