AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
BAKERSFIELD MUNICIPAL CODE AND ZONING MAP
NOS. 82-35, 103-01,103-02, 103-10, 103-11,103-12, 103-
13, 103-14, 103-16, 103-17, 104-01,104-02, 104-03, 104-
04, 104-05, 104-06, 104-07, 104-08, 104 09, 104-10, 104-
11,104-12, 104-13, 104-14, 105-05, AND 105-06 BY
CHANGING THE ZONING OF CERTAIN PROPERTIES
WITHIN THOSE AREAS OF THE CITY OF BAKERSFIELD
HAVING NATURAL SLOPES OF EIGHT (8) PERCENT OR
GREATER, GENERALLY LOCATED OFF PANORAMA
DRIVE, FAIRFAX ROAD AND PALADINO DRIVE AND
EAST OF MOUNT VERNON AVENUE IN THE
NORTHEAST PORTION OF THE CITY OF BAKERSFIELD
WHEREAS, in accordance with the procedure set forth in the provisions of
Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held
a public hearing on a petition to change the land use zoning of those certain properties
in the City of Bakersfield generally located within those areas of the City of Bakersfield
having natural slopes of eight (8) percent or greater, generally located north of
Panorama Drive and Paladino Drive and east of Mount Vernon Avenue in the northeast
portion of the City of Bakersfield; and
WHEREAS, the Planning Commission recommended approval and
adoption of an ordinance amending Title 17 of the Municipal Code to approve adding to
various zones a HD (Hillside Development) overlay zone as described in Exhibit "A"
Legal Description and as delineated on attached Zoning Map Nos. 82-35, 103-01, 103-
02, 103-10, 103-11,103-12, 103-13, 103-14, 103-16, 103-17, 104-01,104-02, 104-03,
104-04, 104-05, 104-06, 104-07, 104-08, 104-09, 104-10, 104-11,104-12, 104-13, 104-
14, 105-05, and 105-06 marked Exhibits "B", by this Council and this Council has fully
considered the recommendations made by the Planning Commission as set forth in that
Resolution; and
WHEREAS, the Planning Commission, as a result of said hearing, did
make several general and specific findings of fact which warranted a negative
declaration of environmental impact and the addition to the various zoning
classifications of the subject properties a HD (Hillside Development) overlay zone, and
the Council has considered said findings and all appear to be true and correct; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's CEQA
Implementation Procedures, have been duly followed by city staff, Planning
Commission and this Council; and
WHEREAS, a Negative Declaration with mitigations was posted on July
24, 1998, and advertised on July 31, 1998, in accordance with CEQA; and
WHEREAS, the proposed zoning is consistent with the General Plan Land
Use Element and Conservation Element policies ensuring that new development be
sensitive to the natural topography, and complements and preserves the aesthetic
integrity of areas adjacent to the bluffs and will ensure the health, welfare and safety
of the public: and
WHEREAS, the purpose of the hillside development ordinance is to
protect the health, safety, and welfare of the community through enforcement of
development standards and regulations in those areas of the city with eight percent
slope or more; and
WHEREAS, the hillside development ordinance is intended to implement
2010 plan policy relating to development within the hillside area of the City of
Bakersfield; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations, as set forth in CEQA and the City of Bakersfield's
CEQA Implementation Procedures, have been duly followed by City staff, Planning
Commission, and this Council; and
WHEREAS, a Negative Declaration was posted on July 24, 1998, and
advertised on July 31, 1998, in accordance with CEQA; and
WHEREAS, a timely and properly noticed hearing upon this ordinance
was held by the Planning Commission of the City of Bakersfield on September 3, 1998,
November 5, 1998, and November 19, 1998, at which hearing evidence, oral and
documentary, was admitted on behalf of said ordinance adoption; and
WHEREAS, the City Council has considered and hereby makes the
following findings:
1. All required notices have been given. Notices of the public hearing
have been posted and advertised in the Bakersfield Californian as a 1/8 page display
notice, as required by applicable City Ordinance and State law.
2. The provisions of the California Environmental Quality Act (CEQA)
have been followed. Based upon an Initial Study, staff has determined that the
proposed project will not have a significant adverse effect on the physical environment,
and that a Negative Declaration is therefore supported. The project is the adoption of
an amendment to Title 17 of the Bakersfield Municipal Code that would apply City-wide
in areas of defined natural slope.
3. Adoption of the Hillside Development Ordinance as proposed is
necessary to protect the health, safety and welfare of the residents of the City of
Bakersfield.
4. This ordinance will ensure that new development is sensitive to the
natural topography.
5. The grading techniques required by this ordinance will preserve the
form of the natural topography and ridge lines.
6. This ordinance will require new development complement and
preserve the aesthetic integrity of areas on or adjacent to the bluffs.
7. Adoption of the Hillside Development Ordinance will implement a
policy of the Metropolitan Bakersfield 2010 General Plan.
8. The proposed ordinance will both permit and regulate development
in defined slope areas based on a variety of physical conditions and constraints.
9. The ordinance provides for its implementation through
establishment of an overlay zoning district, to be known as the Hillside Development
(HD) Zone, that is intended to applied specifically to those land areas within the City
specifically meeting the criteria defined therein.
10. Based on the absence of evidence in the record as required by
Section 21082.2 of the State of California Public Resources Code (CEQA) for the
purpose of documenting significant effects, it is the conclusion of the Lead Agency that
this project will result in impacts that fall below the threshold of significance with regard
to wildlife resources and, therefore, must be granted a "de minimis" exemption in
accordance with Section 711 of the State of California Fish and Game Code.
Additionally, the assumption of adverse effect is rebutted by the above-referenced
absence of evidence in the record and the Lead Agency's decision to prepare a
Negative Declaration for this project.
NOW, THEREFORE BE IT ORDAINED by the City Council of the City of
Bakersfield as follows:
1. All of the foregoing recitals are hereby found to be true and correct.
2. The Negative Declaration is hereby approved and adopted.
3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City
of Bakersfield be and the same is hereby amended by adding a Hillside Development
Overlay Zone to the land use zoning of that certain property in said City, the boundaries
of which property is shown on Zoning Map Nos. 82-35, 103-01,103-02, 103-10, 103-11,
103-12, 103 13, 103-14, 103-16, 103-17, 104-01,104-02, 104-03, 104-04, 104-05, 104-
06, 104-07, 104-08, 104 09, 104-10, 104-11,104-12, 104-13, 104-14, 105-05, and 105-
06 marked Exhibit "B" attached hereto and made a part hereof.
SECTION 2.
This ordinance shall be posted in accordance with provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.
