HomeMy WebLinkAboutORD NO 4134 ORDINANCE NO. ~: 1 3 zt ORDINANCE AMENDING BAKERSFIELD MUNICIPAL CODE SECTION 5.10.120(A)(3) RELATING TO AMBULANCE SERVICE CHARGES WHEREAS, the City Council desires to have greater flexibility in the ability to analyze an application for an alteration of the current rate schedule for ambulance service charges; and WHEREAS, the current ordinance does not allow for Council accommodation of unforeseen delays in the exercise of such flexibility; and WHEREAS, the continuation of ambulance services being provided to the citizens of the City of Bakersfield is necessary for the preservation of public health, safety and welfare; and WHEREAS, the adoption of the Ordinance as an Emergency Ordinance is necessary to insure the ability of the City Council to adequately evaluate proposed ambulance service changes to forestall a potential reduction of ambulance services which could detrimentally impact the public's health, safety and welfare. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. All of the foregoing recitals are hereby found to be true and correct. SECTION 2. Section 5.10.120(A)(3) of the Bakersfield Municipal Code is hereby amended to read as follows: 5.10.120 Ambulance Service Charges. At the public hearing, the Council may increase, decrease, accept, deny, or alter in any other way the charges as submitted. The charges, as increased, decreased, accepted or altered by the City council, shall take effect on April 1 following the public hearing. The City Council may, by a majority vote, determine it is in the best interests of the City that additional information is needed to evaluate the proposed charges, and continue the effective date of the charges beyond the April 1 date, but in no event shall such continuance be for longer than ninety days; provided, however, Page 1 of 3 Pages should the evaluation of such additional information be delayed due to unforeseen events, and the certificate holder submits, in writing, a request to further extend the effective date beyond that established by the City council, the City Council, by majority vote and in its sole discretion, may further continue the effective date beyond the ninety day continuance period. In the event the City council does not take any action to increase, decrease, accept, deny or alter the charges by the effective date, as established, the proposed charges shall be deemed to be denied. SECTION 3. This Ordinance is enacted as an emergency ordinance in accordance with the provisions of Section 23 of the Charter of the City of Bakersfield and shall become effective immediately. .......... ooOoo ..........
