A RESOLUTION AUTHORIZING THE PUBLIC
WORKS DIRECTOR TO EXECUTE AGREEMENT
WITH STATE DEPARTMENT OF
TRANSPORTATION REGARDING THE MOHAWK
SEPARATION OF GRADE PROJECT
WHEREAS, Bakersfield City Council Resolution 033-03 authorized Raul M. Rojas, the
Director of Public Works, to file an application for Streets and Highway Code Section 190
funding for the Mohawk Street Grade Separation Project at the Burlington Northern and Santa
Fe Railroad (Public Utility Commission Crossing No. 2-890.1B); and
WHEREAS, the California Transportation Commission (CTC), acting by and through the
Director of the State Department of Transportation, on May 14, 2003, allocated the amount of
$5,000,000.00 from the Grade Separation Fund to be used to finance the State's share of the
Mohawk Street Grade Separation Project; and
WHEREAS, an agreement is to be entered into between the City of Bakersfield and the
State of California Department of Transportation to provide reimbursement to the City in a sum
not to exceed $5,000,000.00 for the Mohawk Street Grade Separation Project.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. That Raul M. Rojas, Director of Public Works, as agent of the City of Bakersfietd, is
authorized to execute the agreement with the State of California Department of Transportation
for the Mohawk Street Grade Separation Project.
