RESOLUTION MAKING FINDINGS, APPROVING OF
NEGATIVE DECLARATION AND ADOPTING SEGMENT I
OF AMENDMENT TO THE CIRCULATION ELEMENT OF
THE METROPOLITAN BAKERSFIELD 2010 GENERAL
PLAN (CIRCULATION ELEMENT AMENDMENT 3-95).
WHEREAS, the Planning Commission of the City of Bakersfield in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on MONDAY, September 18, 1995 and THURSDAY, September 21, 1995, and
continued to MONDAY, October 16, 1995 and THURSDAY, October 19, 1995, on
Segment I of the proposed amendment to the Circulation Element of the Metropolitan
Bakersfield 2010 General Plan, notice of the time and place of hearing having been
given at least twenty-one (21) calendar days before said hearing by publication in the
Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, such Segment I of the proposed amendment to the Circulation
Element of the Metropolitan Bakersfield 2010 General Plan is as follows:
SEGMENT I
The City of Bakersfield has applied to amend the Circulation
Element of the Metropolitan Bakersfield 2010 General Plan
consisting of changing the Class III bikeway designation to a
Class II bike lane designation on both sides of Alfred Hartell
Highway, north of Highway 178; depicting a Class I bike path
designation on the north side of the future east-west collector
street (Old Walker Pass Road) between Alfred Harrell
Highway and Rancheria Road; and depicting a change from a
future bikeway designation to a Class II bike lane designation
on Rancheria Road north of Highway 178.
and
WHEREAS, for the above-described Segment, an Initial Study was
conducted and it was determined that the proposed project would not have a significant
effect on the environment and a Negative Declaration was prepared and posted on June
19, 1995 and September 1, 1995, accordance with CEQA; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's
CEQA Implementation Procedures, have been duly followed by the city staff and the
Planning Commission and this Council; and
WHEREAS, on July 20, 1995, the Planning Commission held an advertised
public workshop for the purpose of obtaining public comment on the project; and

WHEREAS, a Specific Trails Plan has been adopted for this area, which
depicts bikeway facilities as shown on attached Exhibit "A"; and
WHEREAS, by Resolution No. 79-95 on October 19, 1995, the Planning
Commission recommended approval and adoption of Segment I, as shown on attached
Exhibit "A", and the Council has fully considered the findings made by the Planning
Commission as set forth in that Resolution; and
WHEREAS, the City Council of the City of Bakersfield, in accordance with
the provisions of Section 65355 of the Government Code, conducted and held a public
hearing on WEDNESDAY, JANUARY 10, 1996, on the above-described Segment I of the
proposed amendment to the Circulation Element of the Metropolitan Bakersfield 2010
General Plan, notice of time and place of the hearing having been given at least ten (10)
calendar days before the hearing by publication in the Bakersfield Californian, a local
newspaper of general circulation.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The provisions of CEQA have been followed.
The Negative Declaration for Segment I is hereby approved and
adopted.
4. The report of the Planning Commission, including maps and all
reports and papers relevant thereto, transmitted by the Secretary of the Planning
Commission to the City council, is hereby received, accepted and approved.
5. The Circulation Element Amendment is consistent with the policies
of the Metropolitan Bakersfield 2010 General Plan.
6. The Circulation Element Amendment is needed to reflect the
bikeways shown in Phase 1 of the planning area of the Specific Trails Plan.
7. The City Council hereby approves and adopts Segment I of
proposed amendment to the Circulation Element, consisting of a change to the Bikeways
Master Plan Map, as shown on attached Exhibit "A", generally located along Alfred
Harrell Highway, Rancheria Road, north of Highway 178, and a future east-west
collector street.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
