A RESOLUTION DECLARING INTENTION
TO ESTABLISH THE DRAINAGE PLAN FOR
THE TEVlS RANCH PLANNED DRAINAGE
AREA AND PRELIMINARILY APPROVING
THE COST AND FEE SCHEDULE AND THE
BOUNDARIES OF THE AREA.
RECITALS
WHEREAS, Chapter 16.32.060.D of Title 16 of the Bakersfield Municipal
Code and Section 66483 of the California Government Code, provides for a procedure
by which the City Council may assess and collect fees for the purpose of defraying the
cost of constructing drainage facilities for local and neighborhood drainage areas, and;
WHEREAS, The City of Bakersfield desires to provide storm and surface
water drainage facilities for a rapidly developing area containing approximately 453
acres, in order to prevent drainage damage to land development within the area and to
properly control storm and surface water run-off from said area, and;
WHEREAS, the City is proposing the formation of the Tevis Ranch
Planned Drainage Area to reimburse the cost of the improvements upon subdivision or
development of property within the area, and;
WHEREAS, the fees and charges set forth in Exhibit "A" attached hereto
and incorporated by reference, do not exceed the reasonable estimated cost of
providing the services for which the fees are charged.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The foregoing recitals are true and correct and are incorporated
herein.
2. The Council hereby preliminarily approves the cost estimate and
fee schedule attached hereto as Exhibit "A", and the boundary of the "Tevis Ranch
Planned Drainage Area" area as described on the map attached hereto as Exhibit "B".
Subdivision or development of property within such area will require payment of fees
per the attached schedule.
