THIS PAGE ADDED TO PROVIDE ADEQUATE SPACE FOR RECORDING INFORMATION (Additional reoordumg fee a,u91ies) RF NA ST RESOLUTION NO. 1-96 A RESOLUTION ORDERING THE SUMMARY VACATION OF THAT PORTION OF PUBLIC ROAD RIGHT OF WAY FOR JEWETY AVENUE SOUTH OF THE SOUTHERN PACIFIC RAILROAD (ABUTriNG CITY BLOCK 551) IN THE CITY OF BAKERSFIELD TITLE Ol DOCUMENT RESOLUTION NO. ~' ~' 9 6 A RESOLUTION ORDERING THE SUMMARY VACATION OF THAT PORTION OF PUBLIC ROAD RIGHT OF WAY FOR JEWE~r AVENUE SOUTH OF THE SOUTHERN PACIFIC RAILROAD (ABUTTING CITY.BLOCK 551) IN THE CITY OF BAKERSFIELD WHEREAS, Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code authorizes the City Council to summarily vacate certain public street or highway rights of way; and WHEREAS, ALlREZA BASHIRTASH, ABDOLREZA BAS HIRTAS H, AND FARHAD BASHIRTASH, petitioned the Council to summarily vacate that portion of public road Right of Way for Jcwctt Avenue south of the Southern Pacific Railway (abutting City Block $51) in the City of Bakersfield described in full in Exhibit "A" attached hereto and incorporated as through fully set forth herein, and WHEREAS, the subject future street area is eligible for summap/vacation on the basis that said area has ben determined to be excess right of way of public street not required for street of highway purposed; and WHEREAS, said future street area is unnecessary for present or prospective public street purposes: and WHEREAS, The Planning Commission, at its meeting of December 21, 1995, considered and found that the proposed vacation is consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. All the foregoing recitals are found to be true and correct. General Plan. The proposed vacation is consistent with the Metropolitan Bakersfield 2010 3. In accordance with Section 8334 (a) of the California Streets & Highways Code, that portion of public road Right of Way for Jewett Avenue south of the Southern Pacific Railway (abutting City Block 551) in the City of Bakersfield, described in Exhibit "A" attached hereto, is excess right of way of a street not required for street or highway purposes. 4. It has been determined that proposed summary vacation is exempt from the requirements of the California Environment Quality Act pursuant to Section 15061 (b)(3) in that there is no possibility that the action could have a significant effect on the environment. 5. Pursuant to Chapter 4 of Part 3 of Division 9 of the Streets and Highway Code, the above-described street right of way is hereby vacated and from and after the day this resolution is recorded, shall no longer constitute a right of way for public street purposes. 6. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City. to be recorded in the Office of the County Recorder of the County of Kern, California. Containing 2,211 square feet (more or less).
