HomeMy WebLinkAboutRES NO 20-96RESOLUTION NO. ~ 0 - 9 6 A RESOLUTION DETERMINING THAT CORE RELATED STRUCTURAL WORK, CONSTRUCTION OF THE STRUCTURAL REPAIRS TO THE MECHANICAL ROOM FLOOR AND WALL AT THE CONVENTION CENTER, REPAIRS TO THE SWITCH GEARS IN THE ELECTRICAL ROOM AND MONITORING OF HAZARDOUS MATERIALS CANNOT BE REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING THEREFOR. WHEREAS, the City of Bakersfield has retained Honeywell Inc. to retrofit the heating, ventilation, and air conditioning (HVAC) facility at the Bakersfield Convention Center; and WHEREAS, during the technical investigation stage of the contract for HVAC services it was discovered that the mechanical room floor and wall were much more extensively damaged than originally thought due to the leakage of calcium chloride onto the mechanical room floor; and WHEREAS, the technical investigation also identified that one of the roof trusses required structural strengthening to provide adequate support for the new arena air handler and this roof truss was found to be encapsulated with asbestos.; and WHEREAS, extensive damage to the switch gears in the electrical room due to calcium chloride seeping through the mechanical room floor was discovered; and WHEREAS, due to the fact that failure of the mechanical room floor and wall and the switch gears in the electrical room could happen at any time, the City has determined that structural repairs should be implemented as quickly as possible; and WHEREAS, Honeywell Inc., must remove existing cooling equipment from the mechanical room and replace it with new cooling equipment; and WHEREAS, the City has procured an agreement with Dresser Services Inc. for the the asbestos and chromium contamination abatement and said abatement must be monitored by certified hazardous materials monitoring contractors; and WHEREAS, Honeywell Inc., must integrate and coordinate asbestos removal and monitoring, structural and electrical repair work with the HVAC project to ensure a successful completion of the project before the summer months; and WHEREAS, Honeywell Inc., has agreed to provide and coordinate for the design and construction of structural and electrical repairs thus providing for a dynamic integration of design and construction which should expedite completion of the project and provide tunely solutions should problems be encountered during the construction phases; and WHEREAS, splitting the structural and electrical repair work, hazardous material monitoring and construction of the HVAC Project into separate components and awarding a contract for the structural repair work, electrical work and abatement monitoring separately will cause unacceptable delays and not guarantee a successful completion of the HVAC Project within the required time frame; NOW, THEREFORE, BE IT RESOLVED as follows: 1. The above recitals are true and correct and incorporated herein by reference. 2. The core related structural work, design and structural repairs to the mechanical room floor and wall and electrical room repairs to the switch gears for the Convention Center and monitoring of hazardous materials can be performed or caused to be performed by Honeywell and/or the City of Bakersfield in order to successfully integrate said structural work with the design and construction of the HVAC system. 3. The Finance Director is authorized to dispense with bidding and this Council, simultaneously with this resolution, authorizes the second amendment to Honeywell's original contract for the design/construction services enumerated herein in an amount not to exceed $1,292,033 and authorizes the agreement with Mike McGuire for the monitoring of said hazardous materials enumerated herein in an amount not to exceed $25,744.40. -2- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on JAN 2 4 ~5 , by the following vote: AYES: COUNCILMEIv~ER DeMOND, CARSON, SMITH, McDERMOTT, ROWLES, SULLIVAN, $ALVAGGIO NOES: COUNCILMEMBER ABSTNN: COUNCILMEMBER ABSENT: COUNCILMEMBER rantciTY CLERK and EX OFFICIO of the Council of the City of Bakersfield APPROVED JAN ~' 4 1~ BOB ~ MAYOR APPROVED AS TO FORM: JUDY K.
