A RESOLUTION DETERMINING THAT ABATEMENT OF
ASBESTOS FOR THE STRUCTURAL MODIHCATIONS TO THE
ROOF TRUSS AT THE CONVENTION CENTER CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE FINANCE DIRECTOR
TO DISPENSE WITH BIDDING THEREFOR.
WHEREAS, the City of Bakersfield has retained Honeywell Inc. to retrofit the heating,
ventilation, and air conditioning (HVAC) facility at the Bakersfield Convention Center; and
WHEREAS, during the technical investigation stage of the contract for HVAC services
it was discovered that one of the roof trusses required structural strengthening to provide
adequate support for the new arena air handler and this roof truss was found to be encapsulated
with asbestos: and
WHEREAS, it was also discovered that the existing cooling towers which are to be
removed and replaced, contained a significant amount of chromium contamination; and
WHEREAS, the asbestos and chromium contamination must be handled, monitored and
disposed of by certified hazardous materials abatement contractors; and
WHEREAS, Honeywell Inc., must coordinate asbestos abatement and chromium
contamination removal with the HVAC project to ensure a successful completion of the project
before the summer months; and
WHEREAS, Honeywell Inc., must coordinate asbestos abatement and chromium
contamination removal with the HVAC project to ensure integration of the project with ongoing
Convention Center contractual obligations; and
WHEREAS, Honeywell Inc., has agreed to provide construction administration and
management for the abatement contractors thus providing for a dynamic integration of design,
construction and abatement which should expedite completion of the project and provide timely
solutions should problems be encountered during the construction phases; and
WHEREAS, in order to successfully complete and integrate the HVAC project by
summer, it is necessary to dispense with bidding for said asbestos abatement; and
WHEREAS, splitting the abatement and monitoring work and construction of the HVAC
Project into separate components and bidding and awarding a contract for the abatement and
monitoring work separately will cause unacceptable delays, interfere with scheduled events at
the Convention Center, and not guarantee successful completion of the HVAC Project within the
required time frame;
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. The abatement of asbestos and chromium contamination and the monitoring
thereof for the Convention Center can be coordinated with Honeywell in order to complete the
project in a timely fashion and ensure integration with ongoing Convention Center projects.
3. The Finance Director is authorized to dispense with bidding and this Council,
simultaneously with this resolution, authorizes the agreement with Dresser Services Inc., for the
asbestos and chromium contamination abatement and the agreement with Akri Corporation for
the monitoring of said abatement enumerated herein in an amount not to exceed $84,019.00 and
$25,744.40 respectively.
