AMENDMENT NO. 1 TO RESOLUTION NO. 178-02
OF THE COUNCIL OF THE CITY OF BAKERSFIELD
ADOPTING THE STREET CUT WORKMANSHIP AND
PERFORMANCE WARRANTY FEE CONFIRMING
EFFECTIVE DATES OF PHASED IN FEE INCREASE.
WHEREAS, Chapter 12.16 of the Bakersfield Municipal Code requires
that the City Council adopt a resolution establishing a workmanship and
performance warranty fee for street cuts; and
WHEREAS, this workmanship and performance warranty fee amendment
was adopted on October 16, 2002; and
WHEREAS, the Resolution 178-02 adopted on October 16, 2002, did not
clearly define the effective dates of phases 2 and 3 of the fee increase; and
WHEREAS, the City Council desires to clarify the effective dates of
phases 2 and 3 to be effective November 1,2003, and November 1, 2004,
respectively.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The above recitals are true and correct and are incorporated
herein.
That the amended fee schedule for the workmanship and
performance warranty fee set forth as Exhibit "A" is hereby
approved and adopted.
The effective date of this resolution, and the workmanship and
performance warranty fee, shall still be November 1, 2002, for
Phase 1.
The effective dates of Phases 2 and 3 are November 1, 2003, and
November 1,2004, respectively.
