I 1 - 9 6 RESOLUTION MAKING FINDINGS, APPROVING OF NEGATIVE DECLARATION AND ADOPTING SEGMENT I OF AMENDMENT TO THE KERN RIVER PLAN ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (KERN RIVER PLAN ELEMENT AMENDMENT 2-95). WHEREAS, the Planning Commission of the City of Bakersfield in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on MONDAY, September 18, 1995 and THURSDAY, September 21, 1995, and continued to MONDAY, October 16, 1995 and THURSDAY, October 19, 1995, on Segment I of the proposed amendment to the Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan, notice of the time and place of hearing having been given at least twenty-one (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, such Segment I of the proposed amendment to the Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan is as follows: SEGMENT I City of Bakersfield has applied to amend the Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan consisting of an amendment to Map Sheet 2 to identify location of two, hA acre parking areas and trail to river, related to Phase 1 of the Specific Trails Plan. Phase 1 planning area is generally located in the vicinity east of Alfred Hartell Highway and north of State Route 178. and WHEREAS, for the above-described Segment, an Initial Study was conducted and it was determined that the proposed project would not have a significant effect on the environment and a Negative Declaration was prepared and posted on June 19, 1995 and September 1, 1995, accordance with CEQA; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by the city staff, the Planning Commission and Council; and WHEREAS, on July 20, 1995, the Planning Commission held an advertised public workshop for the purpose of obtaining public comment on the project; and ~ 9,~6,4~ OR!GI~'IAL WHEREAS, a Specific Trails Plan has been adopted for this area, which identifies a future parking area in the location shown on attached Exhibit "A"; and WHEREAS, by Resolution No. 78-95 on October 19, 1995, the Planning Commission recommended approval and adoption of Segment I, with the deletion of Parking Lot "A" located west of the existing equestrian facility at the boundary of Parcels 4 and 5 of Tentative Parcel Map 9899, and the Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the City Council concurs with the Planning Commission recommendation to delete Parking Lot "A"; and WHEREAS, the City Council of the City of Bakersfield, in accordance with the provisions of Section 65355 of the Government Code, conducted and held a public hearing on WEDNESDAY, JANUARY 10, 1996, on the above-described Segment I of the proposed amendment to the Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan, notice of time and place of the hearing having been given at least ten (10) calendar days before the hearing by publication in the Bakersfield Californian, a local newspaper of general circulation. NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of Bakersfield as follows: 1. The above recitals, incorporated herein, are true and correct. 2. The provisions of CEQA have been followed. The Negative Declaration for Segment I is hereby approved and adopted. 4. The report of the Planning Commission, including maps and all reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City Council, is hereby received, accepted and approved. 5. The Kern River Plan Element Amendment is consistent with the policies of the Metropolitan Bakersfield 2010 General Plan. 6. The Kern River Plan Element Amendment is needed to reflect the parking area (support facilities) and access from the parking area to the trails to and along the river as shown in Phase 1 planning area of the Specific Trails Plan. 7. The amendment procedures as stated in the Kern River Plan Element have been followed. 8. After a duly advertised hearing on September 11, 1995, the Board of Supervisors of the County of Kern made recommendation to approve and adopt Kern River Plan Element Amendment No.2-95, Segment I. 2 ~- m ORIGIH,~L 9. The Planning Commission has duly considered the Board of Supervisor's recommendation at its hearings of September 21, 1995 and October 19, 1995. 10.
