A RESOLUTION DISPENSING WITH BIDDING DUE TO
EMERGENCY TRUNK SEWER LINE REPAIRS UNDER THE
RAILROAD TRACKS BETWEEN ROSEDALE AND
BRIMHALL ON EL TORO VIEJO ALIGNMENT.
WHEREAS, on Monday, January 30, 1996, a video inspection of the Buena
Vista sewer line revealed serious deterioration of a 39" concrete sewer line under the Santa
Fe Railroad tracks occurred; and
WHEREAS, on Monday, January 30, 1996 further investigation detected
chunks of concrete were missing from the sewer line and areas of serious deterioration has
occurred which could result in a collapse; and
WHEREAS, on Monday, January 30, the Public Works Director determined
that trunk sewer line repairs would require outside forces in addition to City staff in order
to remedy the problem; and
WHEREAS, the Public Works Director determined that the defective trunk
sewer line could result in a collapse and constituted an imminent risk to public health and
that the immediate preservation of the public health required the use of outside forces to
repair the defective trunk sewer line and insure that no future collapse would occur; and
WHEREAS, in order to remedy this emergency situation, the Public Works
Director authorized equipment rental, engineering and construction services on a time-and-
materials basis to construct a sewer by-pass system, repair parts of the existing trunk sewer
line and install new sewer pipe in order to prevent a future collapse.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The above recitals are true and correct and incorporated herein by
reference.
2. City Council hereby determines that based on the above recitals an
emergency impacting the public health exists thereby allowing the dispensing of bidding
requirements or bidding procedures as set forth in Section 136 of the City Charter and
Section 3.20.060 of the Bakersfield Municipal Code.
