R~SOLUTION NO.
A RESOLUTION DETERMINING THAT DUST
COLLECTOR EQUIPMENT FOR L&A OAK DESIGNS,
INC., CAN BE REASONABLY OBTAINED FROM ONLY
ONE VENDOR, SHERWIN-WILLIAMS, INC.,
AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE
WITH BIDDING THEREOF; APPROVAL OF AGREEMENT
TO PURCHASE DUST COLLECTOR EQUIPMENT FOR
L&A OAK DESIGNS, INC.
WHEREAS, L&A Oak Designs Inc., must move from its current facility to make
way for a large manufacturer moving to Bakersfield; and
WHEREAS, L&A Oak Designs, Inc., must acquire a dust collector to facilitate its
move into a new location; and
WHEREAS, the City desires to assist L&A Oak Designs Inc., in its efforts to
acquire a dust collector in order to create and retain jobs for low- and moderate-income
persons; and
WHEREAS, only Sherwin-Williams., Inc., is capable of providing the desired dust
collector to meet the time schedule for relocating L&A Oak Designs Inc.; and
WHEREAS, the Finance Director has determined, and has recommended the Council
find, the dust collector equipment can only be reasonably obtained from one vendor,
Sherwin-Williams, Inc., and recommends dispensing with bidding therefore in accordance
with subsection D. 1. of Section 3.20.060 of the Bakersfield Municipal Code.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. Said dust collector equipment can only be reasonably obtained from one vendor
because of the time schedule for relocating L&A Oak Designs Inc.
3. The Finance Director is authorized to dispense with bidding and to negotiate the
purchase of same, not to exceed $30,000.00.
4. The Mayor is authorized to execute a contract, as approved by City staff, with
Sherwin-Williams, Inc., for the purchase of said dust collector.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on March 20, 1996, by
the following vote:
