RESOLUTION MAKING FINDINGS AND ADOPTING THE
CAPITAL IMPROVEMENT PLAN FOR THE SPECIFIC
TRAILS PLAN.
WHEREAS, pursuant to Government Code Section 66000 et. seq., a capital
improvement plan is required to levy fees associated with the Specific Trails Plan; and
WHEREAS, the Specific Trails Plan indicates the approximate location,
size, time of availability, and estimates of cost for all facilities and improvements to be
financed with the fees; and
WHEREAS, a public hearing before the City Council was advertised and
held January 10, 1996, to consider input on adoption of the Specific Trails Plan Capital
Improvement Plan; and
WHEREAS, a public hearing before the City Council was also advertised
and held March 6, 1996, to consider input on adoption of the Specific Trails Plan Capital
Improvement Plan; and
WHEREAS, the adoption of a Negative Declaration for the Specific Trails
Plan is adequate; and
WHEREAS, the laws and regulations relating to the preparation and
adoption of the Negative Declaration, as set forth in CEQA and the City of Bakersfield's
CEQA Implementation Procedures, have been duly followed by City staff and the
Council.
NOW, THEREFORE, BE IT RESOLVED AND FOUND by the Council of
the City of Bakersfield as follows:
1. The above recitals, incorporated herein, are true and correct.
2. The provisions of CEQA have been followed.
3. The Negative Declaration is hereby approved.
4. That the Specific Trails Plan is hereby approved and adopted as the
Capital Improvement Plan for fees levied under the Specific Trails Plan.

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
