HomeMy WebLinkAboutRES NO 44-96RESOLUTION NO. 4 4 - 9 6 A RESOLUTION SUPPORTING ASSEMBLY BILL 2828 WHICH REQUIRES THE STATE TO CREATE A LOCAL AGENCY FISCAL RESTORATION FUND AND REALLOCATE MONIES IN THAT FUND TO THE COUNTIES TO OFFSET THE MONIES LOCAL AGENCIES MUST CONTRIBUTE TO SCHOOLS. WHEREAS, due to State budget shortfalls, counties were required to establish Educational Revenue Augmentation Funds; and WHEREAS, the State requires a large proportion of property tax revenue generated by local agencies (cities, counties and special districts) to be contributed to these Educational Revenue Augmentation Funds; and WHEREAS, these property tax revenue shifts have had a serious and negative impact upon the ability of local agencies to adequately fund law enforcement, fire protection, courts, jails, libraries, health care, parks, and other essential local programs and services; and WHEREAS, local agencies should not have to keep subsidizing the State; and WHEREAS, Assembly Bill 2828 provides that the State be required to create a Local Agency Fiscal Restoration Fund; and WHEREAS, Assembly Bill 2828 further provides that the State contribute any and all general fund revenue it collects which is in excess of the amount collected in the previous year and also in excess of that which must be set aside for schools to the Local Agency Fiscal Restoration Fund; and WHEREAS, Assembly Bill 2828 further provides that the monies in the Local Agency Fiscal Restoration Fund be distributed to the counties, which in turn, are required to place it in the Education Revenue Augmentation Fund, thus, reducing the amount which must be contributed by the local agencies. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield that Assembly Bill 2828, as currently constituted, is hereby supported. .......... o0o ..........
