HomeMy WebLinkAboutRES NO 57-96RESOLUTION NO. 5 7" 9 6 RESOLUTION OVERTURNING THE DECISION OF THE PLANNING COMMISSION AND APPROVING A ONE YEAR EXTENSION OF TIME FOR REVISED TENTATIVE NO. 543§, TENTATIVE TRACT 5478, AND TENTATIVE TRACT 5479 ON CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED WEST OF COFFEE RD. AND NORTH OF HAGEMAN RD. WHEREAS, the Planning Commission, acting as the advisory agency, held a public hearing on April 4, 1996, on the applications for requests for extensions of time for Revised Tentative Tract 5436, Tentative Tract 5478, and Tentative Tract 5479 on that certain property in the City of Bakersfield as shown on the attached (Exhibit "B"); and WHEREAS, the Bankruptcy Court has decreed that the development agreement for Riverlakes Ranch is no longer valid; and WHEREAS, conditions of approval related to payment of local traffic fees and providing water wells are necessary for orderly development and the public health and safety; and WHEREAS, the Planning Commission adopted resolutions to disapprove each of the requests for extension of time and made the following findings for each application: 1. All required public notices have been made. 2. Since the original approval of the subdivision, circumstances regarding mitigation of traffic impacts have changed. 3. The applicant did not agree to conditions of approval which would have mitigated potential transportation impacts resulting from the project. 4. The proposed project could have potentially significant impacts on traffic circulation. WHEREAS, within the time permitted by law, STEPHEN DEBRANCH of DEWALT CORP., filed an appeal to the decision of the Planning Commission to disapprove the extension of time requests for Revised Tentative Tract 5436, Tentative Tract 5478, and Tentative Tract 5479; and WHEREAS, in accordance with the Bakersfield Municipal Code, a noticed public hearing was set forth before the City Council on May 8, 1996 at the hour of 7 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before said City Council 0n Said appeal; and WHEREAS, Fruitvale Properties, L.L.C, property owner, has entered into an agreement attached hereto, with the City of Bakersfield to address local and regional transportation impacts, which was approved by the City Council on May 8, 1996, and attached hereto; and WHEREAS, testimony was given at said hearing; and WHEREAS, the applicant agreed to the conditions of approval as shown on attached Exhibit "A" and the agreement attached hereto; and WHEREAS, a one year extension of time should be granted for each subdivision in order to annually evaluate the circumstances of the Riverlakes Ranch bankruptcy proceedings upon tentative subdivisions, and to evaluate tentative subdivisions with the most current city ordinances and policies; and WHEREAS, the extension of time requests are Categorically Exempt in accordance with Section 15305.h (Class 5) of the City of Bakersfield CEQA Implementation, Resolution No. 212-92, and; WHEREAS, at said public hearing held May 8, 1996, the proposed extensions of time for Revised Tentative Tract 5436, Tentative Tract 5478, and Tentative Tract 5479 submitted by Stephen DeBranch of DeWalt Corp. was duly heard and considered and the City Council found as follows: 1. All required notices have been given. 2. The provisions of CEQA have been followed. 3. The conditions of approval as stated on attached Exhibit "A" are necessary for the orderly development, and public health and safety. 4. The applicant has agreed to the conditions of approval as stated in attached Exhibit "A" and in the attached agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAKERSFIELD as follows: 1. That the above recitals, incorporated herein, are true and correct. 2. That the extension of time is categorically exempt from the requirements of CEQA. (Section 15305 (h)) 3. That the expiration date of Revised Tentative Tract 5436, as outlined above, is hereby extended until February 21, 1997, with conditions of approval shown on Exhibit "A". 2 4. That the expiration date of Tentative Tract 5478, as outlined above, is hereby extended until February 21, 1997 with conditions of approval shown on Exhibit 5. Prior to recordation of each Final Map, the subdivider shall 2.1 submit an enforceable, recordable document approved by the City Attorney to be recorded concurrently with the Final Map which will prohibit occupancy of any lot until all improvements have been completed by the subdivider and accepted by the City. Concurrently with recordation of the Final Map, the following covenant shall be recorded by the property owner: a covenant containing information with respect to the addition of this subdivision to the consolidated maintenance district. Said covenant shall also contain information pertaining to the maximum anticipated armual cost per single family dwelling for the maintenance of landscaping associated with this tract. Said covenant shall be provided to each new property owner through escrow proceedings. Prior to recordation of any final map, subdivider shall dedicate with free and unencumbered title of a water well site to serve the subdivision. The location and size of the well site shall be to the satisfaction of the Water Resources Manager. The City shall pay fair market value for the well site.
