'. Taxes Other TOTAL PAID A RESOLUTION ORDERING THE VACATION OF THE 10 FOOT WIDE "PEDESTRIAN WAY" BETWEEN LAKEVIEW AVENUE AND SOUTH HALEY STREET IN TRACT NO. 1286 IN THE CITY OF BAKERSFIELD. JASON Pages: 4 6/]9/1996 13:32:39 WHEREAS, on Wednesday, April 17, 1996, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1147 declaring its intention to order the vacation of the 10 foot wide "Pedestrian Way" between Lakeview Avenue and South Haley Street in Tract No. 1286 in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt form CEQA according to Section 15061(b)(3) in that there is no possibility that the pedestrian easement vacation could have a significant effect on the environment; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, May 8, 1996, after notices were duly published and posted as required by law. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. The Council hereby orders the vacation of the 10 foot wide "Pedestrian Way" between Lakeview Avenue and South Haley Street in Tract No. 1286 in the City of Bakersfield, County of Kern, State of California and more particularly described as follows: All of the "PEDESTRIAN WAY" being 10.00 feet in width and connecting Lakeview Avenue and South Haley Street in Tract No. 1286 as dedicated to public use and shown on Map of Tract No. 1286 filed for record in Book 5 of Maps, Page 181, in the Office of the Kern County Recorder. Excepting -1- therefrom, any portion lying withing the 20 foot wide public alley in said Tract No. 1286. Said pedestrian easement is unnecessary for present or prospective public use or pedestrian easement purposes and is hereby vacated, pursuant to the provisions enumerated herein.
