Other TOTAL PAID JASON Pages: 4 6/19/1996 13:32:39 A RESOLUTION ORDERING THE VACATION OF THE PUBLIC STREET RIGHT OF WAY FOR GARLAND AVENUE IN THE CITY OF BAKERSFIELD. WHEREAS, on WEDNESDAY, APRH, 17, 1996, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the State of California, passed and adopted its Resolution of Intention No. 1146 declaring its intention to order the vacation of the public street right of way for Garland Avenue in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that the Road Right of Way vacation have a significant effect on the environment; and WHEREAS, at its meeting on April 4, 1996, the vacation was duly heard and considered by the Planning Commission and was £ound to be consistent with the Metropolitan Bakersfield General Plan. WHEREAS, said Council did fix a time and place For hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, May 8, 1996, after notices were duly published and posted as required by law. as follows: NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield 1. The above recitals are true and correct and are incorporated herein. -1- All of the public road right of way for Garland Avenue, in the southwest quarter of Section 13, T. 30 S., R. 27 E, M.D.M., City of Bakersfield, County of Kern, State of California, lying east of the east line of the west 55 feet of said quarter section, per road right of way deeds filed for record in Book 2794, Page 230, 231,233 through 238; Book 5770, Page 1624; Book 6649, Page 1941, Official Records in the Office of the Kern County Recorder, it is unnecessary for present or prospective public use or street purposes and is hereby vacated, subject to the conditions enumerated herein. A non-exclusive easement shall be reserved for public utilities purposes in, under, over and upon the entire above described street area. All of or a portion of the reserved public utilities easement (described in item 3) within said street shall terminate and be abandoned as an easement when the applicant has provided the following: a) Relocation of the existing public utilities (including City storm drain facilities) to public utility company and City of Bakersfield standards and acceptance; and b) Dedication of adequate easements for any relocated public utilities extending through private property with alignments thereof approved by the City and Utility Companies. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California. ...... 000 ......
