HomeMy WebLinkAboutRES NO 51-96RESOLUTION NO. 5 ~ ' 9 § A RESOLUTION OF THE COUNCIL OF THE CITY OF BA/<ERSFIELD DECLARING THE RESULTS OF THE PRIF~%RY ~K3NICIPAL ELECTION FOR THE OFFICE OF MAYOR, AND THE SPECIAL MUNICIPAL ELECTION FOR THE CHA~RTERAMENDMENTS b~ASURES ~D", ~E" AND ~F", HELD IN THE CITY OF BAKEP~SFIELD ON THE 26TH DAY OF MARCH 1996. BE IT RESOLVED by the Council of the City of Bakersfield as follows: SECTION 1. That the City Council does hereby find, determine and declare as follows: a. That pursuant to applicable law, a Primary Municipal Election was held in the City of Bakersfield on the 26th day of March, 1996, for the purpose of electing a Mayor; and b. That said election was held and conducted in conformity with all applicable provisions of law; and c. That pursuant to direction of the City Council, the County Clerk of the County of Kern has heretofore conducted a canvass of the results thereof and has filed with said City Council a certificate relating thereto which has been examined and is hereby accepted by this City Council; and d. That the City Council does hereby accept the canvass of record of said elections as certified by said County Clerk, attached hereto as Exhibit "A," and does hereby resolve, determine and declare the results of said General Municipal Election as follows: MAYOR Bob Price - 31,996 Virgie Witte - 3,779 Jose Quirarte - 1,818 e. That the City Council does hereby declare the following person to be elected to the Office of Mayor: Bob Price SECTION 2. That the City Council does hereby find, determine declare as follows: a. That pursuant to applicable law, a Special Municipal Election was held and conducted in the City of Bakersfield on the 26th day of March 1996; and b. That said election was held and conducted in conformity with all applicable provisions of law; and Co submitting to amendments to That said election was held for the purpose of the voters of said City the following proposed the Charter of the City of Bakersfield: and MEASURE ~D" Shall Section 17 of the City Charter be amended to prohibit a Councilmember from residing outside the ward from which he or she is elected? MEASURE "E" Shall Section (185)3 of the City Charter be modified to allow that any member of the Fire Department may be appointed Assistant Chief or Deputy Chief, as is currently the case with the Chief of the Fire Department? MEASURE Shall Section (217)10b of the City Charter be repealed to bring the lay-off policy into compliance with current labor agreements? d. That pursuant to the direction of the City Council, the County Clerk of the County of Kern has heretofore conducted a canvass of the results thereof and has filed with said City Council a certification relating thereto which has been examined and is hereby accepted by this City Council; and -2- e.
