A RESOLUTION MAKING FINDINGS AND ADOPTING
AN AMENDMENT TO THE KERN RIVER PLAN
ELEMENT (KRPE) OF THE METROPOLITAN
BAKERSFIELD 2010 GENERAL PLAN (GENERAL PLAN
AMENDMENT CASE NO. P96-0289).
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on MONDAY, APRIL 29, 1996 and THURSDAY, MAY 2, 1996, on a proposed
amendment to the Kern River Plan Element (KRPE) of the Metropolitan Bakersfield
2010 General Plan, notice of the time and place of hearing having been given at least
ten (10) calendar days before said hearing by publication in the Bakersfield Californian,
a local newspaper of general circulation; and
WHEREAS, such amendment to the Kern River Plan Element of the
Metropolitan Bakersfield 2010 General Plan is as follows:

City of Bakersfield has applied to amend the Kern River
Plan Element of the Metropolitan Bakersfield 2010 General
Plan by revising the Master Planting List (Table 8-3) of the
Kern River Parkway Plan/EIR, an Appendix to the Kern
River Plan Element;
and
WHEREAS, for the above described Amendment, CEQA does not apply to
the proposed project since the proposed revision of the planting list within the Kern
River Parkway Plan/EIR, an Appendix to the Kern River Plan Element, does not have
the potential to cause any significant effect on the environment, and a Notice of
Exemption pursuant to Section 15061(b)(3) - General Rule of the CEQA Guidelines has
been completed; and
WHEREAS, the law and regulations relating to the preparation of a
Notice of Exemption as set forth in CEQA and the City of Bakersfield's CEQA
Implementation Procedures, have been duly followed by the city staff and the Planning
Commission;
WHEREAS, by Resolution No. 30-96 on May 2, 1996, the Planning
Commission recommended approval and adoption of this General Plan Amendment and
this Council has fully considered the findings made by the Planning Commission as set
forth in that Resolution; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, conducted and held a public
hearing on WEDNESDAY, JUNE 26, 1996, on the above described amendment to the
Kern River Plan Element of the Metropolitan Bakersfield 2010 General Plan, notice of
time and place of the hearing having been given at least ten (10) calendar days before
the hearing by publication in the Bakersfield Californian, a local newspaper of general
circulation; and
WHEREAS, the Council has considered and hereby makes the following
findings:
1. All required notices have been given.
2. The project is exempt from CEQA pursuant to Section 15061 (b)(3)
of the CEQA Guidelines (General Rule).
3. Approval of the proposed amendment to the Kern River Parkway
Plan will implement that Plan's goal for the maintenance and restoration of a high-
quality native riparian habitat along the Kern River corridor.
4. Adoption of this amendment is consistent with the goals, policies
and standards of the Kern River Plan Element (KRPE) and the Metropolitan
Bakersfield 2010 General Plan pertaining to the preservation, maintenance and
enhancement of habitat values in the Kern River corridor.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and
correct.
2. The project is exempt from CEQA pursuant to Section 15061(b)(3) -
General Rule of the CEQA Guidelines.
3. The report of the Planning Commission, including maps and all reports
and papers relevant thereto, transmitted by the Secretary of the Planning Commission to
the City Council, is hereby received, accepted and approved.
4. The City Council hereby approves and adopts General Plan
Amendment Case No. P96-0289, a proposed amendment to the Kern River Plan
Element of the Metropolitan Bakersfield 2010 General Plan, consisting of a revision to
the Master Planting List (Table 8-3) of the Kern River Parkway PlanfEIR as shown on
Exhibit "A" attached hereto and incorporated as though fully set forth.
