A RESOLUTION DETERMINING THAT THE SALE OF
CERTAIN CITY-OWNEDREFUSE CARTS CURRENTLY IN
PLACE ON CONTRACTOR-SERVED PILOT PROGRAM
ROUTES CANNOT BE REASONABLY SOLD THROUGH
THEUSUAL BIDDING PROCEDURES AND AUTHORIZING
THE FINANCE DLRECTOR TO DISPENSE WITH BIDDING
THERFORETO SELL SAID CARTS TO THECONTRACTOR
FOR A NEGOTIATED AMOUNT OF $59,822.91
WHEREAS,

refuse collection; and
City entered into Agreement no. 91-71 in 1991 Kern Refuse Disposal Inc.
with the purpose of conducting a pilot program for automated residential
refuse carts for said pilot
WHEREAS, City provided, at its own expense,
program; and
WHEREAS, City entered Agreement no. 96-63 on March 20, 1996 as an
amendment to Agreement 91-7l, whereby Contractor willconvert said pilot program to
provide automated residential refuse collection throughout the Contractor's service area;
and
WHEREAS, Contractors shall furnish necessary refuse carts for its service
area; and
WHEREAS, both City and Contractor find it mutually agreeable and cost-
effective for Contractor to acquire said carts in said pilot program at a fair value and
incorporate them into said conversion of service; and
WHEREAS, said carts have been used foran average of 29% of their useful
service life of ten years; and
WHEREAS, the Finance Director recommends the Council find sale of said
carts in place cannot reasonably be obtained from more than one vendor as per the
Public Works Director recommendation and recommends the Council dispense with
bidding under subsection D.1. of Section 3.20.060 of the Bakersfield Municipal Code.
NOW THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
