RESOLUTION AGREEING TO ACCEPT TITLE FROM THE STATE OF
CALIFORNIA TWO (2) PARCELS OF HIGHWAY RIGHT-OF-WAY ON
PIERCE ROAD SOUTH OF STATE HIGHWAY 204 AND AGREEING TO
ASSUME MAINTENANCE AND CONTROL UPON STATE
RELINQUISHMENT AND WAIVING FURTHER NOTICE.
WHEREAS, THE CITY OF BAKERSFIELD, previously agreed, per City Council
Resolution No. 163-93, to accept title from the State of California of that parcel of right-of-way
on Pierce Road south of State Highway 204 Designated as Relinquishment Request No. 82366
agreeing to assume maintenance and control upon State Relinquishment by the State; and
WHEREAS, the State of California is the owner in fee of two parcels of State
highway right-of-way on Pierce Road just south of State Highway 204; as said parcels are shown
(designated as Segment 1 and Segment 2), outlined in red, on the map entitled Exhibit "A"
attached hereto and made a part hereof; and
WHEREAS, the State of California has requested that the above described parcels
(Segments 1 and 2) be added to Original Relinquishment Request No. 82366; and
WHEREAS, State has acquired said parcels for the sole purpose of extending and
improving Pierce Road and its intersection with the State Highway 99/Airport Drive off-ramp; and
WHEREAS, Pierce Road is a local agency operated and maintained facility; and
WHEREAS, upon completion of Pierce Road improvements by State, the
improvements and rights-of-way should properly belong under the jurisdiction of the City of
Bakersfield.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
That the City of Bakersfield agrees to accept title to said highway right-of-way
(said Segment 1 and Segment 2) and assume control and maintenance of said
highway right-of-way upon relinquishment by the State of California.
That the City of Bakersfield does hereby waive the 90 day's notice
requirement of the intention of the California Transportation Commission to
relinquish such State highway right-of-way as provided in Section 73 of the
Streets and Highways Code of the State of California.
That the City Clerk is directed to forward two (2) certified copies of this
resolution to the State Department of Transportation, District 06, 4491 West
Shaw Avenue, Fresno, California 93722.
