A RESOLUTION DETERMINING THAT AUTOMATED
REFUSE AND GREENWASTE CARTS FOR EXPANSION
OF THE CITY'S COLLECTION PROGRAM CANNOT
REASONABLY BE OBTAINED THROUGH USUAL
BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH BIDDING
THEREFORE, NOT TO EXCEED $250,000, AND TO
PURCHASE THE CARTS.
WHEREAS, City has previously purchased over 50,000 automated refuse
and greenwaste carts for its collection program from Toter Inc., and
WHEREAS, the City completed implementation of its automation program
utilizing said carts; and
WHEREAS, the City entered Agreement No. 96-63 in March 1996 with Kern
Refuse Disposal, Inc. (Hauling Contractor) to phase in automated residential refuse and
greenwaste service; and
WHEREAS, Agreement No. 96-63 provides that
necessary greenwaste carts for the program to be implemented
Hauling Contractor; and
the City will furnish
in areas served by
automated
color, and
WHEREAS, new homes in areas contiguous to those currently receiving
refuse and greenwaste service require additional carts of similar design,
specification; and
WHEREAS, the Finance Director has determined and has recommended
that this Council find, that said carts can only reasonably be obtained from one vendor
because of the compatibility with existing equipment and has recommended that this
Council authorize dispensing with bidding therefor in accordance with Subsection D.1
of Section 3.20.060 of the Bakersfield Municipal Code.
NOW THEREFORE, BE 1T RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. Said carts can only be reasonably obtained from one vendor
because of compatibility of said carts and the need to successfully integrate this into the
existing City system.

3. The Finance Director is authorized to dispense with bidding and to
negotiate the purchase of same, not to exceed two hundred fifty thousand dollars
($250,000).

I HEREBY CERTIFY that the foregoing Resolution was passed and
adopted by the Council of the City of Bakersfield at a regular meeting thereof held on
