A RESOLUTION DECLARING REAL PROPERTY
SURPLUS TO THE NEEDS OF THE CITY AND
AUTHORIZING THE FINANCE DIRECTOR TO
NEGOTIATE ITS EXCHANGE
WHEREAS, in 1988 the City acquired approximately 3.5 acres described in
Exhibit '~A" attached hereto for a drainage retention basin; and,
WHEREAS, Valley Baptist Church has requested the City exchange its property
described in Exhibit "A" for approximately 3.5 acres owned by the church described in
Exhibit "B" attached hereto to facilitate the expansion of its facilities; and,
WHEREAS, the exchange and the relocation of the drainage retention basin
would be at no cost to City; and,
WHEREAS, on October 17, 1996, the Planning Commission found the exchange
of these properties to be consistent with the Metropolitan Bakersfield 2010 General Plan
pursuant to Government Code Section 65402.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The foregoing findings and recitals are true, correct and incorporated
herein.
Real property located on the east side of Fruitvale Avenue between
Hageman Road and Olive Drive is hereby declared surplus and the Finance
Director is authorized to negotiate the exchange of the City's property for
the church's property. The real property is more fully described in Exhibit
"A" and "B" attached hereto.
I HEREBY CERTIFY that the forgoing Resolution was passed and adopted by the
Council of the City of Bakersfield at a regular meeting thereof held on I~0¥ O $ 1~6 , 1996
