A RESOLUTION AUTHORIZING THE FILING OF FINANCIAL
ASSISTANCE APPLICATION AND NEGOTIATION AND
EXECUTION OF A LOAN CONTRACT FOR A STATE
REVOLVING LOAN TO UPGRADE AND EXPAND
WASTEWATER TREATMENT PLANT NO. 2.
WHEREAS, the City of Bakersfield owns and operates Wastewater
Treatment Plant No. 2; and
WHEREAS, Wastewater Treatment Plant No. 2 is in need of upgrade and
expansion costing in excess of $25,000,000; and
WHEREAS, the State of California administers a revolving loan fund used
for providing partial funding of wastewater and water reclamation projects; and
WHEREAS, it is in the City's interest to obtain partial funding for the
Wastewater Treatment Plant No. 2 upgrade and expansion from the State Revolving Fund
to be repaid over twenty years at less than effective market interest rates; and
WHEREAS, the State Revolving Fund loan will be repaid solely from the
City's Wastewater Fund with no reliance upon general fund revenues; and
WHEREAS, the City Council needs to formally authorize staff to make
application for a State of California loan and to negotiate and execute a loan contract
therefor.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. That the Public Works Director or his designee is hereby authorized
and directed to sign and file, for and on behalf of the City of Bakersfield, a Financial
Assistance Application for a loan from the State Water Resources Control Board in the
amount not to exceed Ten Million Dollars ($10,000,000.00) for the design and construction
of Wastewater Treatment Plant No. 2 upgrade and expansion; and

2. That the City Manager or his designee is hereby authorized to
negotiate and execute a loan contract and any amendments or change orders thereto on
behalf of the City of Bakersfield.
I HEREBY CERTIFY that the foregoing Resolution was passed and
adoptedby the Council of the City of Bakersfield at a regular meeting thereof held on
