A RESOLUTION MAKING FINDINGS, APPROVING
NEGATIVE DECLARATION AND ADOPTING OF
PROPOSED AMENDMENT TO THE SPECIFIC PLAN
AMENDMENT P96-0587 OF PROPOSED AMENDMENT
TO THE RIVERLAKES RANCH SPECIFIC PLAN.
WHEREAS, the Planning Commission of the City of Bakersfield, in
accordance with the provisions of Section 65353 of the Government Code, held a public
hearing on MONDAY, SEPTEMBER 16, 1996, and THURSDAY, SEPTEMBER 19,
1996, on Specific Plan Amendment P96-0587 of a proposed amendment to the RiverLakes
Ranch Specific Plan, notice of the time and place of hearing having been given at least twenty-
one (21) calendar days before said hearing by publication in the Bakersfield Californian, a
local newspaper of general circulation; and
WHEREAS, sucl~ Specific Plan Amendment P96-0587 of the proposed
amendment to the RiverLakes Ranch Specific Plan as follows:
Specific Plan Amendment P96-0587
Michael Dhanens, representing Fruitvale Properties has applied to amend the RIVERLAKES
RANCH/UNIBELL SPECIFIC PLAN AND THE RIVERLAKES RANCH SPECIFIC PLAN as
follows:
a) Delete all references to "Unibell" in the document except where it is required for historical reasons -
RiverLakes Ranch has been developed as two distinct areas: the area east of Coffee Road known as
RiverLakes Ranch Specific Plan and the area west of Coffee Road known as RiverLakes Ranch/Unibell
Specific Plan; Fruitvale Properties has acquired that area known as RiverLakes Ranch/Unibell Specific
Plan and Unibell International Co., Ltd. is no longer a partner in the RiverLakes project; hereafter, the
project will be known only as RiverLakes Ranch;
b) Eliminate Chapter 11 in its entirety, thus creating a single document entitled the "RiverLakes Ranch
Specific Plan" which covers the original 1,901.80 acre land base of the Rancho Laborde Specific Plan -
Chapter I addressed development on 1,383.5 acres in the RiverLakes Ranch/Unibell Specific Plan area
while Chapter lI addressed development on 518.30 acres in the RiverLakes Ranch Specific Plan area; the
elimination of Chapter II will create a single document that addresses the entire 1,901.80 acre project
site;
c) Create one set of development standards for the entire plan area - Both Chapters I and II contain a
separate set of development standards, the new developer wishes to consolidate such standards into a
single set of standards for the entire plan area;
d) Revise the wall and landscape treatment of the "Unibell" portion to match that in the area east of
Coffee Road - Both Chapters 1 and II contain a separate set of "wall and landscape plans" which create
dissimilar street scape/landscape view in each of the specific plan areas; a single set of street
scape/landscape plans will create a similar look throughout the 1901.80 acres area.
and
WHEREAS, for the above-described Segment, an Initial Study was conducted,
and it was determined that the proposed project would not have a significant effect on the
environment, and a Negative Declaration was prepared; and
WHEREAS, the law and regulations relating to the preparation and adoption
of Negative Declarations as set forth in CEQA and City of Bakersfield's CEQA
Implementation Procedures have been duly followed by city staff and the Planning
Commission; and
WHEREAS, by Resolution No. 90-96 on September 19, 1996, the Planning
Commission recommended approval and adoption of Specific Plan Amendment P96-0587
subject to conditions listed in Exhibit "A" and this Council has fully considered the findings
made by the Plaiming Commission as set forth in that Resolution; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, conducted and held a public hearing on
WEDNESDAY, OCTOBER 23, 1996 on the above described Specific Plan Amendment P96-
0587 of the proposed amendment to the RiverLakes Ranch Specific Plan, notice of time and
place of the hearing having been given at least ten (10) calendar days before the hearing by
publication in the Bakersfield Californian, a local newspaper of general circulation; and
findings:
WHEREAS, the Council has considered and hereby makes the following
1. All required notices have been given. Notice of public hearing before
the Planning Commission of the City of Bakersfield for the project with the associated
proposed Negative Declaration was advertised in the Bakersfield Californian as a 1/8 page
advertisement and posted on the bulletin board of the RiverLakes Ranch Beach Club, the
Bakersfield City Clerk bulletin board and the Bakersfield Development Services Department
bulletin board.
2. The provisions of the California Environmental Quality Act (CEQA) and
the City of Bakersfield CEQA Implementation Procedures have been followed. Staff
determined that the proposed activity is a project, and an Initial Study was prepared and a
Negative Declaration was prepared and duly noticed.
3. A Negative Declaration for the proposed project is the appropriate
environmental document to accompany project approval. In accordance with CEQA, staff
prepared an Initial Study for the proposed project and indicated that the project will not
significantly impact the physical environment.
4. The project must be granted a "de minimis" exemption with respect to
the payment of Fish and Game Section 711 fees. Based on the absence of evidence in the
record as required by Section 21082.2 of the State of California Public Resources Code
(CEQA) for the purpose of documenting significant effects, it is the conclusion of the Lead
Agency that this project will result in impacts that fall below the threshold of significance with
regard to wildlife resources and, therefore, must be granted a "de minimis" exemption in
accordance with Section 711 of the State of California Fish and Game Code. Additionally, the
assumption of adverse effect is rebutted by the above-referenced absence of evidence in the
record and the Lead Agency's decision to prepare a Negative Declaration for this project.
5. School districts and the North Bakersfield Recreation and Park District,
which provide services to this area, should be aware of Specific Plan Amendment P96-0587
and should concur with the applicant that such amendment will not adversely affect existing
school and park sites and the ability of such districts to provide services and facilities within
the project boundary.
6. Consolidation of the two chapters into one chapter will create a single
set of development guidelines in one location creating less confusion regarding the application
of such standards and guidelines. Pursuant to City Council Resolution No. 81-90 approving
RiverLakes Ranch/Unibell Specific Plan as Chapter One of the specific plan text and
RiverLakes Ranch Specific Plan as Chapter Two of the specific plan text, two different sets of
development guidelines and standards have existed for guiding development in that area
generally known as RiverLakes.
7. Residents/property owners of RiverLakes Ranch Specific Plan, that area
of RiverLakes Ranch located east of Coffee Road, without the consent of such
residents/property owners should not be the recipients of or be responsible for maintenance of
the pocket parks, linear parks, lakes or beach club located within that portion of RiverLakes
Ranch known as the RiverLakes Ranch/Unibell Specific Plan project.
8. The dwelling unit cap of 4,430 dwelling units, and the density and
acreage per residential type shall not be amended for that portion of RiverLakes Ranch known
as the RiverLakes Ranch/Unibell Specific Plan project.
9. Existing Land Use Element land use designations and Specific Plan land
use designations for both the RiverLakes Ranch and RiverLakes Ranch/Unibell Specific Plans
shall not be amended with this specific plan amendment.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the
City of Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and correct.
2. The Negative Declaration for Specific Plan Amendment P96-0587 is hereby
approved and adopted.
3. The report of the Planning Commission, including maps and all reports and
papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City
Council, is hereby received, accepted and approved.

4. The City Council hereby approves and adopts Specific Plan Amendment
P96-0587 of the proposed amendment to the RiverLakes Ranch Specific Plan, constituting
changes as shown above in the specific plan amendment description and as shown on map
marked Exhibit "B," attached hereto and incorporated as though fully set forth, for property
generally located between Noriega Road, Rosedale Highway, Fruitvale Avenue and Calloway
Drive, subject to conditions of approval shown on Exhibit "A".

SUBJECT: RIVERLAKES RANCH SPECIFIC PLAN
Prior to 1986, the City of Bakersfield approved the Rancho Laborde Specific Plan
covering property bounded by Rosedale Highway on the south, Norris Road on the north,
Fruitvale Avenue on the east and Calloway Drive on the west. The property owners, Jean
and Madonna Laborde, later filed bankruptcy.
In June, 1986, the City of Bakersfield and Clifford E. Bressler (trustee of the
Chapter 11 bankruptcy proceeding) entered into a development agreement for
development of the property covered by the Rancho Laborde Specific Plan (the "Rancho
Laborde Development Agreement").
In June, 1989, Riverlakes Ranch, with Unibell International Co., Ltd. as its General
Partner, acquired approximately 1,384 acres of undeveloped real property in northwest
Bakersfield. This property is bounded by Rosedale Highway on the south, Norris Road on
the north, Coffee Road on the east and Calloway Drive on the west.
In November, 1989, the entire Rancho Laborde Specific Plan was renamed the
Riverlakes Ranch Specific Plan.
In June 1990, the portion of the Riverlakes Ranch Specific Plan which was acquired
by Riverlakes Ranch and Unibell, was amended. That portion was named the "Unibell
Specific Plan." The unamended Riverlakes Ranch Specific Plan remained in place on the
property to the east of Coffee Road.
In July, 1990, the portion of the Rancho Laborde Development Agreement which
covered the property covered by the Unibell Specific Plan (on the west side of Coffee
Road) was amended, and named the "Riverlakes Ranch/Unibell Development Agreement".
This development agreement was never formally assigned, as required in the Agreement,
to any subsequent owners of property within the Unibell Specific Plan area.
On June 30, 1994, Riverlakes Ranch, Ltd. filed for bankruptcy protection. In
January, 1996, the Bankruptcy Court issued an order that the development agreement
covering the property of the debtor (the Riverlakes Ranch/Unibell agreement) had not
been assumed by the debtor and was therefore no longer in effect.

Those property owners who acquired their property within the Unibell Specific Plan
area prior to June 30, 1994, and who received all of their discretionary approvals prior to
that date, may continue to rely on the development agreement for their projects. Any
property owner requiring-~iscretionary approvalS'subsequent to June 30, 1994 may not
rely on the development sgreement and must develop in accordance with adopted City
standards and ordinances.
