RESOLUTION NO. 1 4 0 - 9 6
A RESOLUTION ORDERING THE VACATION OF THE
PUBLIC STREET RIGHT OF WAY FOR KENDALL WAY
AND WEYBRIDGE DRIVE IN TRACT NO. 5220 IN THE CITY
OF BAKERSFIELD.
WHEREAS, on WEDNESDAY, NOVEMBER 6, 1996, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements
Vacation Law," being Chapter 3 of Part 3 of Division 9 of the Streets and Highways Code of the
State of Cali£ornia, passed and adopted its Resolution of Intention No. 1144 declaring its intention
to order the vacation of the public street right of way for Kendall Way and Weybridge Drive in Tract
No. 5220 in the City of Bakersfield; and
WHEREAS, for the above-described project, it was determined that the proposed
vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that
the Road Right of Way vacation will have a significant effect on the environment; and
WHEREAS, at its meeting on December 21, 1995, the vacation was duly heard and
considered by the Planning Commission and was found to be consistent with the Metropolitan
Bakersfield General Plan.
WHEREAS, said Council did fix a time and place for hearing all persons interested
in or objecting to said proposed vacation, which hearing was held on Wednesday, December 4,
1996, after notices were duly published and posted as required by law.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.

All of the public road right of way for Kendall Way and Weybridge Drive in
the City of Bakersfield, County of Kern, State of California, more particularly
described in Exhibit "A", is unnecessary for present or prospective public use
or public street purposes and is hereby vacated, subject to the conditions
enumerated herein.
A non-exclusive easement shall be reserved for public utilities purposes in,
under, over and upon the entire above described street area.
A non-exclusive easement shall be reserved for municipal services provided
by the City of Bakersfield over entire above described street area.
The City Clerk shall certify to the passage of this Resolution and shall cause
a certified copy hereof, attested by the Clerk under the seal of the City, to be
recorded in the Office of the County Recorder of the County of Kern,
California.

Two (2) parcels of land being portions of the public street right of way in Tract No. 5220,
filed for record in Book 38 of Maps, Page 171, in the Office of the Kern County Recorder,
said right of way being more particularly describe as follows:
PARCEL 1 (KENDALL WAY)
All of the right of way for Kendall Way southeasterly of that line described as follows:
Beginning at the most southwesterly corner of Lot 1 of said Tract No. 5220;
THENCE South 30° 44' 26" West, 60.00 feet terminating at the most northerly corner of
Lot 12 of said Tract No. 5220.
PARCEL 2 (WEYBRIDGE DRIVE)
All of the right of way for Weybddge Drive eastedy of that line described as follows:
Beginning at the most northerly corner of Lot 9 of said Tract No. 5220;
THENCE North 30° 27' 46" East, 67.00 feet, terminating atthe most southwesterly corner
of Lot 10 of said Tract No. 5220.
